High court says claim if murder plot does not stop alimony

A retired St. Louis police captain must continue to pay his ex-wife $2,425 a month in maintenance, even though he claimed in a civil action that she tried to have him killed, the Missouri Supreme Court ruled this week.

In a unanimous decision, the judges said Tuesday that neither the settlement agreement of Joseph and Ida Richardson, nor the divorce decree, nor Missouri statutes allow for a change in the financial arrangement.

Ida Richardson's attorney, Elizabeth H. Christmas, had argued before the court in December that the so-called plot was never the subject of a police report or a criminal investigation.

But Joseph Richardson's lawyer, Chet Pleban, contended that Richardson could use the alimony case itself to make the accusation in a civil court.

Pleban argued that his client could potentially be paying for his own hit man.

If the court ruled the other way, then every single guy in the country would stop paying alimony and claim that his ex-wife tried to kill him.

And there is the rub. Without a criminal investigation or report this guy's claim is just hearsay. I have to side with the judge on this one.

Not that the courts aren't stacked against men in these situations... However, this stinks. If someone tried to kill me, you can bet there would be a police report and an investigation of some kind. Besides, if he's dead... she doesn't get paid, right? Sounds like she would have to be pretty dumb to kill the goose that's laying golden eggs.

Who's lying? Beats me... but it's usually a good idea to follow the money.

It didn't sound like he proved the plot, but just alleged it. And why would she have him whacked? He's her cash cow!

The divorce and family courts in this country are ferociously under the control of the FemiNazis. Even to the extent of mandating a man to pay for his own assassination!

Actually, if I remember correctly, Reader's Digest had a story in "That's Outrageous" where a man tried to hire a hitman to kill his wife. He was caught and sent to prison for attempted murder. While in prison, his wife divorced him. Since Colorado is a no-fault divorce state, the court awarded alimony to the husband in prison, since he had no income and his wife had a job. No-fault divorce laws are insane!

Alimony is nothing but legal blackmail IMO. Child support, yes, Alimony, no. All alimony laws should be rescinded. Once again this is just my opinion. I am NOT paying alimony, BTW.

Yes, but there needs to be a provision for two spouses to enter into an agreement i.e. "I am going to forgo my career and raise the kids, so if you dump me you need to pay me alimony".
