There are two Oregons, Wacko Portland, Eugene, and the public emp;oyes that live in Salem. The rest of the state is consevative but many of them are rinos. This group works for a living and pays taxes.

The idiots supporting him burned SUVs right after he was convicted in 2001 before he was sentenced which is one reason why the original sentence was high as it was.

Eugene, Oregon is a strange place, if Luers is freed he will likely come back here in 'rock star' mode. And do more arson and animal liberation front actions which he has also done in the past.

The guy is an arsonist and a vandal, and should be treated as such. Terrorists target PEOPLE. This guy didn't.

The people who call this guy a terrorist are probably the same people who call burglars terrorists, carjackers terrorists, and armed robbers terrorists. They're criminals, but calling them terrorists simply cheapens the term and makes it that much harder for people to appreciate the dangers of REAL terrorism.

He's an arsonist and a vandal, and should spend a LOT of time in prison for that. But Gitmo? Al Queda? Are you people serious? These nutjobs aren't even in the same league as the terrorists we're fighting. Are we now going to declare that the 12 year old kid who spray painted my back fence last week should be sent to Gitmo because his graffiti included gang code for "Kill The Police"?

Oregon has always been a magnet for the counter culture and Portland and Eugene are enclaves of some rally radical people.

Luers has quite a few friends in Eugene in particular as this is a hot bed of tree sitters and fur and meat industry haters in particular.

I'm sure if I went to the cafe next to the activist office building down on Willamette St. I would see the usual shiftless, dirty and unemployed rabble all excited by this.

I am afraid if Luers is given another long sentence. Things could start burning in revenge just as things could start burning if they encourage it by freeing this perp.

Letters should be sent to the registerguard.com eugeneweekly.com sites to let the powers that be know we don't want Luers freed.

Note to self-described anarchists: Circumstantial evidence is, nevertheless, evidence of guilt. Of course, his own admission of guilt at his sentencing hearing should dispel any silly notion that there was anything "wrong" with the use of circumstantial evidence in convicting him...

I vacationed in OR once and loved it. I am a trees hills water kind of gal.

At that time I was oblivious to any political climate. It is too bad that your great state is inhabited by so many weirdos.

Fortunately it was unexpectedly cold that morning foiling the crime.

Had the trucks and tank farm blown up, people would have died in their sleep and homes would of burned.<<

I looked them up. They sell 50 millions gallons a year. If they had even one million gallons on hand at a time then this was a major terrorist attempt - a long sentence is appropriate.

It is also next to the main rail line and Internet/phone trunk lines buried next to it.

Obviously if this had gone off it would have disrupted information flow and commerce in a big way too.

I think the title of this post is a little misleading. He isn't going to be set free. The Court of Appeals just ruled that some of his convictions should have been merged during sentencing.

"On appeal, defendant assigns error to the trial court's denial of his motions to sever certain charges and to suppress certain evidence, to its denial of his motions for judgments of acquittal as to certain counts, to its failure to merge specified convictions, and to various aspects of the sentences imposed. We agree that the trial court erred in failing to merge defendant's three convictions for first-degree arson and in failing to merge his two convictions for attempted first-degree arson. We either reject or do not reach his other assignments of error. We therefore reverse and remand for merger of the relevant convictions and for resentencing, vacate his remaining sentences and remand for resentencing, and otherwise affirm."

Most of Luers' sentence is for first-degree arson, which carries a mandatory 7 1/2 -year prison term,

He wouldn't have been treated so harshly if he had just stole and destroyed classified documents

This case happened in 2001 and the adjudication of this case sent him to prison a long time and this good result should be preserved. Let's hope the re-sentencing doesn't release him with time served.

Political prisoner? Okay I will try that defense next time I get stopped for a hit and run. WTF? how can you be a political prisoner in a country that allows you to be tried in the court of law and judged by a jury of your peers?

That is a popular tactic here. A perp going by the name 'Rob los Richos' who was involved in a 'Take back the streets' rally where Eugene anarchist blocked streets and destroyed business property threw a large piece if concrete hitting a cop in the upper chest injuring him.

He is also "a political prisoner" of note locally. We have many such people here who live to disrupt and harass, and whenever the cops stop them, 'they complain they are being oppressed.'

Such is life in this city.
