NC Attorney General Agrees to Mike Nifong's Request to Be Removed From Duke Lacrosse Case

RALEIGH, N.C. — The state attorney general's office agreed Saturday to take over the sexual assault case against three white Duke University lacrosse players at the request of the embattled district attorney.

Durham County District Attorney Mike Nifong, hamstrung by a flip-flopping witness — a black woman hired as a stripper — and dogged by allegations that he made inflammatory statements to the media, asked Attorney General Roy Cooper's office Friday to appoint a special prosecutor.

"I wish I could tell you this case would be resolved quickly," Cooper said at a news conference Saturday. "Since we have not been involved in the investigation and prosecution, all of the information will be new to our office. Any case with such serious criminal charges will require careful review."......"

I hope they can wrap up the case as far as the students are concerned quicker than the last paragraph suggests.

Indict the stripper for false testimony.

Disbar Nifong.

Fire that a-hole President of Duke.

Sue the living bejesus out of Duke for civil damages.

I hope they sue Duke into the ground. Let it be a warning shot to the PC chuckleheads that run these schools that freedom and liberty outrank their Soviet sensibilities. Of course Nifong has been a good little apparatchik, but he's going down!

Schadenfreude. I never really appreciated the nuances of this word until I beheld the burgeoning fallout from this incident. I LOVE to see liberals hoisted on the petard of Political Correctness, racial identity politics, gender determinint feminism and what I have coined as "Tawana Brawley Syndrome".

TBS exists when one takes a historical reality such as the marginalization of innocent blacks within a once overtly racist crminal justice syndrome or the past subjagation of women or any number of other offenses and attempts to apply that to a contemporary situation wherein the objective facts don't apply; ala OJ Simpson, Rodney King, Anita Hill etc.

Nifong was not only hoping to ride to re-election a wave of politically motivated outrage from the Black community over this contretemps, but I suspect that he was seeking to appropriate PC bonus points and obtain instant moral authority by championing the cause of the "other" (marginalized black exotic dancer) against racist male chauvinist members of the privliged white elite. A case of cultural Marxist Class warfare that boomeranged. GOD how I love it so!!!!!

The State has 2 choices as I see it. Eiother drop the charges or face the same lawsuit the County should face. The State has bigger pockets.

I think they will drop the case but after a delay. Nifong would want the case to go on until he gets through the Bar trial. As long as there is even the smallest chance of a conviction Nifong looks slightly less depraved.

The alumni made this case fall apart, suing them would hurt the campus. Just sue the government. The people of the state did this not the campus.

You may be right,but that sure isnt fair to the accused men. Holding out on them so this pr**k can look good.

I sure hope the boys attorneys start pushing hard for trial or dismissal.

I am sure the defense attorneys will aggressively seek a dismissal and in due course will probably get it, but that should have happened already.

I've metioned this before during this saga.. .

Nifong is a despicable piece of refuse, he should be disbarred, . . .

BUT. . .

There is something known as absolute presecutorial immunity. . . Prosecutorial immunity protects prosecutors from civil law suits brought based upon their conduct of a criminal prosecution.

Now...fasten your seat belts. . .here's the best part:

Prosecutorial immunity is (as noted above) absolute. Which means that even if a prosecutor goes so far as to charge and prosecute someone for a crime that they know they didn't commit - let's say for personal reasons - the law says that the prosecutor is immune from civil suit. Period.

Have it again: No matter what a prosecutor does during the course of a prosecution, he/she remains immune from civil suit.

(Okay...stop yelling at me...I didn't write the law...But that's the way it is...)

Now for the (slightly) good news...

Even though Nifong cannot be civilly sued for the things he has done... It is possible for a prosecutor to be *prosecuted" criminally, if what he has done constitutes a violation of civil rights under federal criminal civil rights statutes.
