CAMP PENDLETON A prosecutor said Tuesday that a Marine accused of kidnapping and killing an Iraqi civilian in April while deployed should not face the death penalty.
The recommendation came after the testimony of three investigators in Lance Cpl. Jerry E. Shumate Jr.'s Article 32 hearing the military equivalent of a grand jury proceeding or preliminary hearing.
A decision on whether Shumate will face court martial is to come later.
During brief testimony in the hearing Tuesday, an investigator testified Shumate became emotional, grabbed a map and wrote a statement on the back of it while she interviewed him.
Naval Criminal Investigative Service Special Agent Kelly Garbo said she interviewed Shumate in May while investigating allegations that an Iraqi civilian had been kidnapped and killed by Marines.
Garbo said Shumate alternated between being calm and upset during the two-hour interview May 11, and at one point started crying.
He was getting very emotional. He grabbed a map and started writing on the back of it, she testified.
A second NCIS special agent, Kyle Casey, testified that Shumate was interviewed a second time in Fallujah on May 18, but the contents of Shumate's statements were not divulged during the hearing.
Shumate, 21, is one of seven Marines and a sailor accused of kidnapping and killing an Iraqi civilian April 26 in the town of Hamdaniya. He is the third to face a hearing on the charges.
Shumate has been charged with premeditated murder, kidnapping, assault and other crimes in the death of Hashim Ibrahim Awad, 52. He also has been charged with assault in an unrelated case involving an Iraqi civilian that took place 16 days earlier near Hamdaniya.

Any news articles about the Pendleton Eight or the Haditha Marines has to be studied to the Nth degree before any comments are made on them.
Clearly each article is being written in such a way as to condemn the Marines before they are court martialed.

Amen! We send them over there to defend us and when some iraqi punks conjure up a story the government eats it up, it like the viewing public swallows the fauxtographs from Lebanon.
This trial is wrong, Wrong WRONG!!!!! This is how we would have lost WWII!
This country is going spineless.
Emotional or not does not indicate guilt or innocence in this case due to it's extremly high stressed months of captivity. I simply await the outcome. May it be fair and impartial in the final analysis.
