A Terrorist Win (Judge's ruling on wiretapping)

Judiciary: Detroit Judge Anna Diggs Taylor has agreed to the American Civil Liberties Union's demands to shut down the National Security Agency's wiretapping program. Terrorists everywhere are cheering.

The 73-year-old Judge Taylor, appointed by Jimmy Carter in 1979, has a long history as a radical. In 1964, she helped set up a Mississippi office of the National Lawyers Guild, which Congress in 1950 called the "legal bulwark of the Communist Party."

What happened Thursday was nothing less than a judicial disarmament of the U.S. — stripping away some of our most valuable weapons in the global war on terror.

I doubt this is an opinion with any weight or consequence.

The government got a stay pending appeal at this stupid ruling will be overturned on appeal.

I got, some of the feedback I got was that this was overtly ideological, that the legal reasoning on it was thin. And this question of the standing of these folks you're talking about, the scholars and the journalists and so on, and whether they actually had standing to bring this suit"

I'm with you. This is just more fluffy, feel good, "moral victory", BS lib nonsense. Her decision will be overturned by the 6th court, and in the end, the only result will be a big fat waste of taxpayer dollars.

Why is this no surprise? Why does it seem like the city who's very name embodied "Made in the USA" now seems more like "Home of terrorists"?

I sincerely hope the NSA lives up the hype heaped upon it by spy novelists and Liberal Hollywod in general, I hope they find some way to keep the game goin' without detection. Is there any cause the ACLU would not back up, insofar that it amounted to the detriment of the USA?

Totally agree. I hope that lots of Dems publicly side with her decision. That will simply show the public that Dems must never again be put in a position where they can affect the appointment of these kook judges. Her decision will be overturned, and she has done the Pubbies a great service.

I thought that a judge's ruling had effect only in that particular district. How can a single district court judge rule on something with nationwide effect?

There should be a rule or bill or something that limits the number of times a federal judge can be overruled on appeal. Once the number is reached, they get canned.

What I remember of first year law (and that's not much) is that it just has to be an issue over which there is federal juridiction which in this case is just a question of federal constitutionality. The district federal court is not limited to matters that are confined to its geographic district.
