New Medi-Cal rules kick in

A law requiring Americans to prove citizenship to receive Medicaid takes effect today, but millions of Californians won't have to do so until August.

The California Department of Health Services, which oversees the state version of Medicaid, known as Medi-Cal, won't be ready to comply with the federal law until early August, director Sandra Shewry said this week.

She said state law must be changed and social-service workers in California's 58 counties trained to meet the new requirements. Until then, the process for applying for Medi-Cal and renewing participation in the program will remain as it is now.

The federal legislation, sponsored by two Republican members of Congress from Georgia and signed into law earlier this year, aims to purge illegal immigrants from the federal health program for the poor.

This legislation affects all state run Medicaid programs, not just California.

Want to bet there is a flood of renewals between now and August. I vote they have to renew the renewals made between June 30 and August 31.

And our NOMINAL "Republican" Governor will NOT help enforce this federal LAW because like the troops on the border HE won't think it's necessary!!! Well, la-- de-- da-- Phhhhhhhhhhhht!!!

What that broad meant when she said that the law will have to be changed is that currently Calif. State law gives illegal aliens welfare and food stamps automaticly and qualifies them for Medical.

The feds should refuse to finance any Medi-CAL claim that doesn't include the necessary proof of citizenship. If they provide treatment to a non-citizen, California can just eat the cost from the state treasury until they figure out how to comply.

I understand that! What bugs the heck out of me is that a REAL CONSERVATIVE REPUBLICAN Governor would pounce on this to expidite the law change, forthwith!!! But Schwartzenegger will NOT!!! Like the broad, he'll stand on one foot, then the other while explaining to all of us how difficult and complex "the process" is and how it will take a long, long time to implement.

As you well know, this, from one who strongly supported Prop 187 as he ran during his hijacking of the grassroots conservative signature gathering and recall organizing. The dude's a FRAUD!!!

He's not worthy of holding the office because he goes to Republican National CONventions swearing alliegance to Republicanism, then goes home to CA and destroys it's CA platform!!!

He also will thwart this federal law and should be called to account for helping illegals with federal tax monies against the will of our federal house of representatives during his effort at re-election.

Election time is the ONLY time you can really hold these turkey's feet to the fire!!!

In reading articles about the recent Democrat's attempt to provide health insurance for illegal alien children, there was mention of a change in federal funding that would have made the state funding levels grow exponentially from what was being quoted. I wonder if this is the change that they were referring to.

And in ``rare circumstances,'' two people can file an affidavit testifying to a recipient's citizenship, according to federal guidelines released earlier this month.

In addition, people will not be excluded from the program while they are trying to obtain their documents.

How do school records reflect one's citizenship or immigration status, other than by self-reported data? I'm sure some schools require a birth certificate, but there are scores of thousands of "undocumented" children in schools.

Couldn't three people agree to vouch for each other's citizenship? And, before a nonresident alien finds those two people to testify to his citizenship, he can still assume multiple identities to benefit from Medicare.

Gerardo Luviano is looking for somebody to rent his Social Security number. Mr. Luviano, 39, obtained legal residence in the United States almost 20 years ago. But these days, back in Mexico....he is looking for an illegal immigrant in the United States to use it for him - providing a little cash along the way. "My brother in California has a friend who has crops and has people that need one."

Mr. Luviano's pending transaction is merely a blip in a shadowy yet vibrant underground market....undetected by American authorities, operating below the radar in immigrant communities from coast to coast, a secondary trade in identities has emerged straddling both sides of the Mexico-United States border.

Illegal immigrant workers usually earn so little they are owed an income tax refund...........The illegal immigrant "working the number" will usually pay the real owner by sharing the tax refund. Since legal American residents can lose their green cards if they stay outside the country too long, it is useful to have somebody working under their identity north of the border.

"Sometimes the one who is working doesn't mind giving all the refund, he just wants to work," said Fernando Rosales, who runs a shop preparing income taxes in the immigrant-rich enclave of Huntington Park, Calif.

The income tax "refund" is almost certainly generated by Earned Income Tax Credit (EITC) fraud, which as a "legal resident" the number renter would qualify to receive, especially if they have have or claim children. The EITC is a "refundable tax credit, which means the IRS will pay it out even if no taxes have been withheld or paid in. So the IRS gives filers who claim the EITC "refunds," even if they have had no taxes withheld.

These number renters can claim up to $4,400 for the 2005 tax year in EITC "refunds," most of the number renters probably claim this maximum refund. The Additional Child Tax Credit is another "refundable" credit which is no doubt routinely claimed by these renters.

For 2005, if the number renter claimed $14,400 in wage income, and three children, between the EITC and the Additional Child Tax Credit the renter would, without having any taxes withheld from wages, receive a tax "refund" of $4,898, plus have $892 credited to Social Security; in addition to the potential of thousands of dollars in California unemployment compensation.

Because they have the power of the purse---and control your tax dollars---public officials who represent you are required to be bonded. Elected officials--- and employees on the government payroll--- might have incurred imprisonment, fines, or other criminal penalties for violating the terms of bonding by misusing tax dollars.........specifically by aiding and abetting the activities of illegal aliens, and failing to report that crimes were being committed.

PARTIAL LIST OF IMMIGRANTS' FEDERAL CRIMINAL FELONIES


1 - Use of illegal ID or documents
2 - Federal income tax evasion
3 - Re-entry into USA after deportation
4 - Obtain/Operate vehicles with illegal ID
5 - ID theft/fraud - Social Security fraud
6 - Knowingly gaining employment fraudulently
7 - Recruiting other illegal aliens workers
8 - Transporting illegal aliens
9 - Harboring &/or housing illegal aliens
10 - Undermining US national security
11 - Registering/Voting using fraudulent documentation
12 - Conspiracy to violate federal statutes
13 - Uttering false statements to public officials
14 - Obstructing law enforcement
15 - Solictiation to violate state and federal law.

Elected officials and public employees on the government payroll might have lied on insurance bonding applications, and may have filed false bonding applications and/or insurance claims. Similar penalties apply to insurance organizations.

Now, say public funds went missing and the public official failed to get bond coverage; the state would have no way to recover that money other than restitution through a criminal prosecution. If it is determined a public official broke the law by failing to apply for bond coverage, that could be an actionable offense.

Now, if a public official with bonding had previous financial problems---perhaps a bankruptcy or a job loss for financial improprieties, etc---that they failed to reveal to bonding agents, that might subject them to legal penalties.

Public entities that mandate bonding include: Municipalities, counties, townships, school districts, ambulance districts, volunteer fire departments, community college districts, public universities, transit authorities, landfills, sewage treatment facilities, public works maintenance facilities, airports.

Concerns here center on instances when elected officials allowed government agencies to misuse tax dollars-----allowing illegal using phony documentation to get government benefits, health vare, welfare, food stamps, drivers licenses, to fraudulently vote in elections for tax-exempt public bond issues...........these are examples of fiduciary negligence, and could violate bonding regulations, and the requirements of the bonding carrier.

"Full Medicaid benefits are available only to citizens and legal immigrants who have been in the country for more than five years. A few benefits, such as labor and delivery care, are available regardless of citizenship."

Been here 5 years? Why? Why is 5 years the magic number. Labor and delivery regardless of legal status and 5 yr rule won't apply. Ridiculous! Of course labor and delivery for the anchorbabies.

Frankly taxpayers are tired of supporting illegals and their anchorbabies. Pregnant ones are coming here just to get the best prenatal care for FREE while American Mom's who don't "qualify" for medicaid and their babies suffer.

Neonatal care for the anchorbabies can run in the hundreds of thousands of dollars all funded by American taxpayers.
