So if he has been sentenced than why bother going to trial again. If his crimes deserve the death sentence than they should pursue it. Who knows, folks in VA, may decide to abolish the death penalty.
Maybe someone can explain the point, I say his victim's in Maryland deserve the same resolution as those in Virginia.

Gansler is a panty waist. He was the one who sniveled about how Maryland doesn't execute "children", so Malvo would be safe here. Now its the same with the elder sniper. This is why Ashcroft had them moved to Virginia in the first place.
The snipers killed more people in Montgomery than anywhere else.

That's ridiculous logic on the part of this prosecuction. They should act without regard to what's been done in another state. That case may fall apart on appeal, and then what happens? Suppose VA has a moratorium on executions or abolishes it altogether?
I agree: his victims in Maryland are no less worthy of the fullness of justice than those in Virginia.

The law also requires proof that two or more people were killed in a single incident. Weird law. Kill one get life, kill two, scare the DA into thinking he might lose.
Sounds like this guy Gansler is not sure he can get the murder conviction so he's going for the lesser charge. It's Maryland's laws. Oh well. At least they can't set him free with the Va convictions in place. ugh..

The prosecutor's refusal to pursue death will only bolster the leftist argument that murderers of blacks do not receive death penalties. In liberal-dominated (democrat) areas of Maryland, murderers do not face execution. In more reasonable (i.e. Republican) areas of Maryland, murderers routinely face the ultimate punishment.
It is a sad state when liberals can use their own incompetence as justification to eliminate reasonable punishment. But, then again, democrats realize that every murderer who is executed is one fewer eventual democrat voter.

I mean I can understand how satan himself would be given life under the 9th court of appeals, And yu can get death in Texas like no where else. But Md. is next to Va., are they just that different or is there a different appeals court between the two?

Wouldn't it be great if someone could find a loophole in the Interstate Commerce Clause (or whatever it's called) and states that don't have the DP but had tried death penalty cases and found the scum guilty, could ship them to other states that do have the DP for quick disposal?
In return, we taxpayers in non-DP states could house and feed lesser criminals until their sentences were served.
