Deputy sued for using stun gun on woman

NOBLESVILLE, Ind. (AP) - A Hamilton County sheriff's deputy faces a lawsuit for using a Taser on a woman who refused to put down her cell phone after she was stopped on suspicion of drunken driving.

Jennifer Marshall says she was trying to phone her lawyer when Deputy Greg Lockhart pressed the stun gun to her arm as another deputy held her.

Police contend Marshall refused to drop the cell phone after Lockhart warned her she would have to go to jail if she did not submit to a blood test.

Hamilton County Sheriff Doug Carter says Lockhart followed department policy and the lawsuit is without merit.

A video camera in the police car recorded the arrest outside a convenience store in Fishers.

Also, I never said "routine." That was a one-sy.

Another was me simply dropping a girl, fellow waitress, off from work at around midnight. I dropped her off at her door/driveway, which the cop saw. He then proceded to pull me over for no reason. (a rash of burglaries in the area that I could never confirm)

Another was my brother and driving along in broad daylight, we were simply yucking it up and laughing visibly, but at last check that's no crime. Or wait, maybe it is today.

Anyway, we passed two cops in a cruiser at a T-stop that they were at. They decided to pull in behind us and pull me over. I read them the riot act after they had absolutely no explanation for pulling me over. Good thing I had my bro with me, eh! Or else who knows what they may have concocted. BTW, I never even made eye contact with them on the way by initially.

They let me go and were visibly distressed at my asking information from them. They issued no citation, probably b/c we had not done anything wrong, and let us go. Now, why, in your wisdom, would that happen?

There are others, but until you can answer those simple ones, I'd suggest you quit knowing more about what's happened to me than I do.

I found this laughable, even if they didn't have a legitimate reason for pulling you over I'm sure they would have been smart enough to say you were speeding or something. I seriously doubt a police officer pulled you over for no reason and after you "read them the riot act" they just coward away in fear of the repercussions for harassing you. Your living in a fantasy world.

Can you give me the department and the name of the officer who arrested you for drunk driving, I'd like to send him a thankyou card. Stop blaming the police and take some responsibility for your own mistakes.

Could you please give me one example of any jurisdiction in the US that has a zero tolerance policy against drinking and driving. Because what you are saying is that in some jurisdictions the legal limit is .01 not .08. I know there is zero tolerance for minors but not adults. So if you can give me the name of one jurisdiction that has a zero tolerance law for adults maybe I won't think your such an idiot.

Your the one making the mistakes, and then having to deal with each one after another as we present you with the facts.

Bottomline, follow the money.... DUI (drunk or not) is big big money for the lawyers and the courts...probably rating up there with some fortune 500 companies.

I never said dui's don't make money for the courts so why you bring that up I don't know. My argument is if somebody knows drinking and driving is against the law and they choose to do it then they should be man enough to accept responsibility for it instead of blaming their mistakes on the cops.

Just because you don't agree with a law doesn't give you the right to ignore it. It sounds like you found this out the hard way.

I suppose the cops in Cincinnati, well documented, didn't really suffocate that kid by wrapping his head with celophane either. Or whatever it was before you have a heyday with the chemical composition. LOL

Or the tazer'd 67 year old woman or however old she was. You're right, pardon me, the police are always perfect. Sorry Mr. Officer. ; )

And how many times have you heard of a cop cutting someone a break when they've pulled them over for speeding after the person pulled over read them the riot act?

I will tell ya this, they were giving my car a pretty damn good 'onceover' however. Good thing I keep up with my inspections, etc. ; )

I would think if a police officer pulled somebody who "read them the riot act" the officer would write them a ticket. You don't strike me as the kind of person who is going to intimidate a cop with your intelligence.

When you read those ofc's "the riot act" did you get tasered? Just wondering because a lot of people in here seem to think that cops taser everybody who shows a little attitude towards them.

I saw an officer taser a man because he didn't want to talk to him. He simply pulled the taser wires off, threw it back to the officer and ran faster than the officer did. The man was innocent and it was the funniest thing I saw last summer.

CONVICTED isn't always guilty. Many people think that the American jury trial is a sure way of determining guilt or innocence. It is not ,and never will be since it is a game played by two opposing teams of lawyers for high stakes but not personal loss. Witnesses are prevented from testifying what they know not only by criminal threats but by court rules.The huge number of cases ensure a less than perfect exploration of every case.Judges also have human weaknesses and make mistakes. Juries are too often made up of the people who couldn't get out of jury duty,and in any case,have all the biases,weaknesses,and prejudice of humans. One of these is a strong tendency to believe that the accused is guilty otherwise the authorities would not have arrested him.

Those people also tend to think people should instantly and without reservation obey any order of an official.

It is also possible ,even likely,that some officers will look on tasers as a way of "teaching a lesson" to less than perfectly cooperative suspects ,a way that doesn't leave bruises like rubber hoses and nightsticks do.

Videotaping with sound is a very good thing;fully informed juries is another ,and probably rarer.

Look, there are example after example of crooked cops all over the place. They busted an enormous ring in D.C. just a handful of years ago. Huge.

It's foolish to think that all cops are honest when clearly they aren't. Yeah, there've been plenty of news items whereby cops use tazers or unreasonable force under circumstances. I can only put forth my experiences in support. Most of them occurred when I was much younger, but occurred nonetheless. If readers want to choose not to believe them, then fine. One day if something similar happens to them, then perhaps they'll remember it.

I've even had cop friends tell me what a bunch of A-holes some other cops are. He told me that they're constantly doing illegal things such as asking questions that they're not supposed to ask in order to give them cause to search the car, etc. He said they can get away with it because the average citizen isn't familiar with all the laws. Well that's nice!

Now, I could be lying as one has suggested. But assuming I'm not, then what does that tell us? It certainly isn't a ringing endorsement.

But hey, if you're foolish enough to think that all cops are honest, none will use excessive force, that every time they pull you over they will always be within the law, that they always do everything they can when filling out reports properly, etc., then feel free. No skin off of my back. I was just commenting. But hey, since all I've done is lie, please just disregard. ; )
