My old torts teacher in law school would always answer that question with this retort: you can always file a suit but you might not win.

He has sued others (papers) for suggesting he is homosexual. He has won.Kate Moss sued a British tabloid for suggesting she did cocaine just last year. She won. No wonder the tabloids were thrilled when footage of her snorting like a pro found the light of day.

The larger question in my mind is whether or not a lawsuit would require him to indeed, "come out of the closet".

...On this logic, the First Amendment gives breathing room to creative works even when they fail in their goals. Thus, here, the "South Park" episode is protected even if its literalization of the "in the closet" metaphor won't make a single viewer chuckle...
Really?
I was laughing my arse off...
Oh, and BTW, there is no way in hell a lawsuit would prevail...

That dude in Napoleon Dynamite is a much better actor than Tom Cruise.
"GOSH!"
I read somewhere that he was paid something like $1,000 for the role. A terrible injustice...so "vote for Pedro and all of your wildest dreams will come true."
Sumtin' like that! I'd watch the "dude in Napoleon Dynamite" over ANY Tom Cruise movie.

"Battlefield Earth" was a very good book?

Different tastes for different people I guess. At the time I was reading it, I was stuck out in the desert for about a month and so I read that......

Don't know if he'll sue - but I do know that it'll be fun to watch if he does!
