Very intersting point was brought up by Judge O'Conner; in that if it IS legal for a MD to provide lethal injection for a state sanctioned execution; why is it argued that assisted suicide violates federal drug statutes.

O'Connor forgot that the Supremes already totally federalized the death penalty. The states act as mere agents for the Supreme Court in death penalty cases.

This is different ~ it's not an execution, although someone is undoubtedly going to come up with the idea of extending the privilege to those not charged with any capital crime.

We could call that the "third trimester".

Exactly. This was a home run question for the anti-death side---the kind of question the justices ask in anticipation of an argument where they want to develop the opposition to the argument.

No, they are the same animal. The White House position is that assisted suicide is protected by federal mandates on controlled substances. If this is true, then a MD may not do this for a convicted criminal. It's either legal, or it is not.
