WASHINGTON -- Ward 8 Councilman Marion Barry is in legal trouble for not filing federal or D.C. income tax returns since 1998, News4's Tom Sherwood reported.
Barry is completing the first year of his new term on the D.C. Council and has been mentioned as a potential candidate for council chair next year.
But now, sources tell News4 that Barry will plead guilty to a misdemeanor offense for failing to pay federal income taxes for seven years. Details are being worked out with U.S. Attorney Kenneth Wainstein and other federal authorities.
Sources said the agreement does not require any jail time and does not involve any fines but it does require Barry to get his records in order and filings up to date.
The plea agreement must still be approved by a federal court judge in a hearing that may come as early as this week.
All officials involved with the case declined comment to News4.

Here is a serious question: If you are required by law to file an income tax return and it WILL be used against you in a court should the IRS decide that you aren't fully truthful about your income, does it violate your constitutional right against self incrimination to also require you to sign it?
Barry should be black balled, black listed, black.. (fill in the blank!)

If the IRS disclaims some deductions you claimed in good faith, for example, then it wasn't perjury to sign your form.
The B**** set him up.
But don't you see the Catch 22? The law REQUIRES you to submit a return and then the law REQUIRES you to sign it. Please don't go the "If you aren't doing anything wrong, you won't mind" route.
No Catch 22 here at all, if you understand the term the way I do. If you sign your name to a contract . . . there is no inherent right to misrepresent yourself, anywhere, in the eyes of the law. I suspect that your ire is best directed elsewhere.
Very sadly, one must question how the heck the voting contsituency in DC can re-elect Barry, such a pre-disgraced piece of vermin. With a grin, he's probably lighting up right now and lord knows with who.
