China Shocked at Border Officer's Acquittal

1 hour, 11 minutes ago

China expressed shock at the acquittal of an American border officer accused of roughing up a Chinese tourist and said it will closely monitor her $10 million lawsuit against the U.S. government.

Homeland Security officer Robert Rhodes was found not guilty on Thursday of violating the civil rights of Zhao Yan, 38, a businesswoman who was touring Niagara Falls near the Canadian border in July 2004.

Rhodes told the court in upstate New York that Zhao took off running when he ordered her inside his inspection station to question her about a drug suspect with whom he thought she might be associated.

He was charged with using excessive force after he allegedly sprayed her with pepper gas, threw her against a wall and struck her head on the pavement.

Pictures of Zhao's bruised face appeared in Chinese newspaper along with accounts of her ordeal. The Chinese consulate in New York issued a statement on its Web site Thursday condemning the officer.

"The New York consulate-general expresses its shock and regret and hopes the U.S. side truly safeguards the legal rights of Ms. Zhao," the statement said.

"The consulate-general strongly condemns the person who inflicted harm on Ms. Zhao," it added. "The consulate-general continues to monitor closely the situation of her civil lawsuit."

Zhao is suing the U.S. government for $10 million in damages.

Rhodes said he followed proper procedures in subduing Zhao and denied beating her.

The incident angered China, with Foreign Minister Li Zhaoxing at one point raising the case with then-U.S. Secretary of State Colin Powell.

It is stupid of her to try to run away or (according to another report) put her hand into her pocket. Still, this is what Chicom can use to inflame the populace's animosity against U.S..

Here is her picture which was paraded in Chinese media:

Here is the picture of officer Rhodes with her friend at a press conference after his acquittal:

Thanks for the ping. I was just getting ready to blog this story. I'm still looking for an older article on the original incident.

Of course, the Chi coms fail to mention that running from a Chinese Border Guard would have got her shot in the back.

She better not get a dime.

In addition, if a tourist defied a Chinese border officer that tourist would be deemed a "spy" and locked away without trial (like a "trial" means anything there anyway)...

China can go blow itself...

I wondering, how many so-called "American Spies" have the ChiCOMS arrested over the last 55 years? ...to facilitate "bribery" of local/regional/national "ChiCOM officials" for "profit/business as usual" ?

Who, other than a bed-wetting Democrat, gives a crap* about what China has to say about "rights"?

They find large passenger vans and trucks stacked with Chinese coming through New York. One trooper found a van full after he stopped a weaving driver that was tired. Americans get paid to drive these Chinese to New York City and dump them. They blend into the huge population of orientals and they are free to be a New Yorker.........

Chinese government would do way worse to anytone for all sorts of things.

Rather ludicrous for them to complain about this as some sort of human rights issue.

The communists would say that's apples and oranges in that this lady wasn't guilty whereas when they toruture, mutilate and murder people they are guilty -- ie they actually are Christians or Tai Chi practivers or advocates for muti-party rule.
