Rochas suing for wrongful death

Sharon Rocha and her exhusband are pressing forward with a wrongful death lawsuit against Scott Peterson, and on Monday a Stanislaus County Superior Court judge said the case will go to trial next spring.

Their daughter's husband is on death row, Scott and Laci Peterson's Covena Avenue home in Modesto has been sold, and money from an insurance policy on Laci Peterson will go to Sharon Rocha.

But the grieving parents don't want to leave any stone unturned.

"We just want to make sure there's a very substantial judgment in there — that Mr. Peterson never sees any green from his efforts," said attorney Gary Davis, who represents Dennis Rocha, Laci Peterson's father.

Sharon Rocha filed the lawsuit on Dec. 19, 2003, nearly a year after her daughter's disappearance prompted a massive search throughout Modesto, the surrounding area and the depths of San Francisco Bay.

Dennis Rocha joined the lawsuit in March, after Peterson was sentenced to death for killing his pregnant wife, whose remains washed ashore near Berkeley.

The Rochas are seeking $25 million — even though they know that Scott Peterson's assets are slim.

If you're sick of the Peterson case, don't read this. But if you're still interested, this is the latest from the Modesto Bee. I'm curious if anyone else thinks that this lawsuit against Scott is as much an indirect action against his parents as it is against Scott. If I had gone through all the Rochas have with Scott and his family, I think I'd consider doing the same. After what Scott did to their daughter and grandson, I wouldn't want to see him getting any sort of profit --or paying off his legal fees with assets that belonged equally to their daughter. (Or assets that were gained because of her death.) And after the insensitive and nasty way Scott's parents have treated them, a lawsuit that wiped out all of Scott's assets would probably protect the Rochas from any further battles with Scott's family over his assets after he's executed.

I think this is a logical final step in the whole messy business. It doesn't do much good to kill the cobra if you leave eggs in the nest. Make an omelet for your mongoose.

The more aggravation caused to Scott's parents the better!

They aided and abetted their miserable rotten spoiled scoundrel of a son and poor Laci paid the price.

I said yesterday and I firmly believe that if Scott had a different attorney than the slimy smarmy Geragos he might well have walked free.

Didn't I read somewhere that the Petersons are still trying to grab as much of the marital property as possible? I don't think the Petersons--any of them--should profit from what Scott did. Maybe the half-sister, who spilled some of the beans--but the rest--zilch.

I say good on Sharon for doing anything she can to separate her daughter's and her grandson's memories, estates, and existances from the crass, cruel and clueless Petersons.

I hadn't heard about the Peterson's trying to sell the house. Are you saying they are making a completely separate sale from what Sharon is doing? I've love to read that article if you can put your hands, er, mouse on it.

The Petersons aren't suitable to breathe the air on the same planet as Laci's family.

I'm not sure, it might have been one of those news blurbs on Fox or something, but there is some dispute over who gets the house money--and maybe some of the remaining possessions. The Petersons remind me of leeches.

I recently saw a very odd "defense" letter written by Lee Peterson and published in PEOPLE magazine. The man is certain that his son was "framed" for Laci's murder. To me, it exemplifies what a deludinoid this man truly is, and quite possibly, how his son developed into a narcissistic killer. Sometimes, when the only thing a person understands is $$$$$$$, you have to hit them right where it counts to get their attention...........in the pocketbook. God bless Sharon Rocha and all of Laci's family. Don't think for one minute that she will feel any satisfaction going through the civil portion of her daughter's death, though. I am certain, from having gone through something similar myself, she is doing it out of a commitment she has to her daughter and grandson. There is no amount of money in the world which will ever bring her peace, but she will have the satisfaction of seeing what's necessary is completed, all the way through to the bitter, bitter end!

Me either Miz!! I hope Sharon and Dennis Rocha wipe these "horrible" people out. They will never be able to shut the mouth of Lee Peterson that continues to spew pure venom but they can certainly see that neither Scott nor his accomplice parents and siblings profit in any way.!! There is NO amount of money however that can ever pay for the loss of Laci and little Conner.

I saw it too. The man is completely losing his mind. He's completely overtaken with hatred. He makes absolutely no sense. Incidentally, on another forum there is a girl that has a brother on death row in SQ who states that he is expecting Snott to be placed in the cell right beside him. His sister saw Scott and his parents a couple of weekends ago in the visiting cages. She says that Scott is completely shaved bald, skinny and looks like a total shell with nothing inside. The man, I think, has finally GOTTEN IT!! He's cooked.

I think this suit might accomplish a few things, one of which would be reiumbursing the Rochas for the expenses of attending the trial, but more important, I really, really, really do not want to see any of the Petersons make so much as a penny off of this tragedy. I'm hearing that "Son of Sam" laws are no longer in force--and moneygrubbers that they are, the Petersons might stoop to anything to make a buck.

A while back --I can't remember if it was during the trial or just after-- the Petersons came up to Modesto with a truck and loaded a bunch of stuff out of the Scott/Laci home, which I don't believe they were allowed to do until everything was settled after the trial. I think one of the neighbors saw what was going on and called the Rochas and someone called the media. The news media and I think one of the Rochas was right there with the cameras in the Peterson's faces as they drove off with some stuff --what stood out about that event was that Scott's mom looked pretty healthy, though even more bitter, without her oxygen tank. I guess because all the time I saw her with the oxygen I wondered if it was a prop to gain sympathy. Like somehow she expected people to have more forgiveness toward Scott because his poor mother is sickly. Anyhow, I doubt Gerragos came cheap. They must be deep in dept after the trial. But defending someone who is guilty comes with a price, especially if that person is your rotten son.
