PROSECUTORS SEEK SEALED LIMBAUGH RECORDS

WEST PALM BEACH, Fla. (AP) - Palm Beach County prosecutors who want to examine Rush Limbaugh's medical records for their prescription drug abuse investigation are going to court Monday in hopes of having that evidence released.

The records were seized in late 2003, as prosecutors looked into allegations that the conservative commentator went "doctor shopping" to illegally acquire pain medication. Limbaugh, 54, of Palm Beach, has not been charged with any crime and has denied any criminal wrongdoing.

Limbaugh's attorneys fought the seizures, claiming a violation of privacy rights. But last month the Florida Supreme Court declined to hear his appeal, clearing the way for prosecutors to finally look over the records.

The records are under seal in the possession of Palm Beach Circuit Judge Jeffrey Winikoff. A hearing on the issue is scheduled for Monday.

Prosecutors went after Limbaugh's medical records after learning he received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his oceanfront mansion.

Limbaugh acknowledged his addiction to pain medication in October 2003, blaming it on severe back pain, and took a five-week leave from his radio show to enter rehab.

The show has 20 million listeners a week and is heard on nearly 600 radio stations.

This is the reason that we are becoming used to not trusting the legal profession. They operate like the Mafia and have no compulsion to disobeying the law. Florida law prohibits this.

Seriously, it is time for Limbaugh to see if he can get the feds interested in malicious prosecution. They might think it is fun to roust him but the fact is Rush is being persecuted now.

actually it is the judicial branch of FL that is fighting a dying death.

Palm Beach and the Palm Beach County SA office is democrat run.

KEEP IN MIND

There is still the ethics complaint that survives the case. Ethics complaints are independent of the case in chief.

Of course the BROWARD COUNTY office of the FL bar which has been assigned the case is OBVIOUSLY SITTING on the complaint. They have no set time table to take action.

I only see a federal court option. (it will be interesting to see what kind of theory pops up)

I also wonder the timing of the notice. Was this done as a short notice effort in order to put this upon the weekend?

I just can't answer that. All my info comes from this short article. Thanks for your information, maybe his attorney, Roy Black, is planning to go for the federal issue.

In a Florida court, Rush has zero chance. Cut and dry case. Democrat party and their minions say, the most influential voice on the right must be silenced and he will be. It may take a while, but he will be silenced.

Yes it is .. and Hillary is surely involved.

Hillary's buddy, Janet Reno, has lots of connections in FL - BAD connections. This whole attack - to seize Rush's records should scare all of us. They took the files illegally - without having charged Rush with any crime .. because they HAVE NO EVIDENCE HE COMMITTED ANY CRIME.

Also .. a part of this "investigation" never focuses on the housekeeper and her husband who purported tattled on Rush - and although they were doing criminal activity - they were given immunity - in order to GET Rush. The lawyer who took their case .. has some connection to the Clintons. I can't remember his name or the details .. but I knew right away this was going to be exploited by Hillary's people.

The dems want desperately to get rid of Rush. But .. since Air America isn't going to do it .. I'm waiting for the next shoe to drop.

This seems so political. There are plenty of people addicted to pain pills that don't have all their medical records seized. They are going after Rush.

And they will not be "careful" with his records, either. They will certainly have a few "accidents" of underlings leaking Rush's medical privacies to the press. Everyone loves to laugh at Saddam in his underwear. To the lefty media, Rush is worse than the butcher of Baghdad. Why, didn't Rush bring down the OKC building??

Rush, I hope your team is working on a strategy.

When I questioned possible repercussions for Bill, my ultimate victim was Hillary. If she is behind this, I do not see the logic.

She wants to run for president - and with Rush bringing out all the bad stuff about her - she will have a difficult time - because he will be constantly exposing her.

I don't see her as a victim at all. She has chosen to stay with the rapist and chief - so she has to pay the consequences for that decision.

The media is hell bent on not apologizing for it's lies. The new plan is to campaign in cities where cable contracts expire to eliminate their opportunities for renewal, free speech killing free speech. The same liberal mindset is now focused on destroying Rush's freedom to medical privacy yet they overlook themselves. Why do you feel a "victory" is not a basis for the same legal procedure with regard to Clinton? Open his closet door and close Hillary's. Patient client will worm it's way into Kerry's military records. Judicial nominees will be paraded through the streets. Elections will be sordid. Where does it end?

They had them in their possession for what, a year ? and had legal access to open them for the day when Rush's lawyer screwed up, so if they were going to release any dirt ? ( what dirt ? ) don't you think the "accidents" would have occurred by now ?
