I'm all for a recess appointment for someone like Bork, but wouldn't Bush have to wait for an actual recess before making a recess appointment?

Bork would be a great choice, but he is entirely too old now. We need someone like Bork who is years and years younger to be able to impact decisions for many years to come. A long lasting impact is of great importance.

Assuming that he replaces Rehnquist then that would make him the second oldest justice on the court. Why waste an appointment on someone who won't be on the court for any length of time?
