State could rescue Schiavo despite judge's denial

The Florida judge who has consistently ruled against efforts to keep Terri Schiavo alive has said no to an effort by the state's Department of Children and Families to rescue the brain-injured woman by physically removing her, but a department spokeswoman says the state agency still could take action without judicial approval.

Pinellas Circuit Court Judge George Greer said the state cannot take Schiavo into custody, nor provide her food or water.

WFLA Radio in Tampa says the ruling will likely be appealed.

The possible "rescue" scenario emerged today with Schiavo now in her sixth day without food or water.

Florida's DCF indicated it might remove the brain-injured woman, by force if necessary,

I am posting this because I did not see it posted already and to help clear up some misinformation that is going around that DCF cannot do anything due to Greer's injunction.

Greer is proof that justice is not only blind but deaf and dumb too. Tar and feathers would be appropriate. I'll settle for impeachment and disbarment.

Please explain to me why Jeb would ask Judge Greer for permission to do something he can and should do as the executive of the state.

A question for all those saying that the Congress has no right to get involved, that this is a state's right issue. If the DCF does this, would you applaud the rule of law in this case? If not please refrain from using the state's rights, Congress overreaching their authority argument, and tell us why you really hold your view.

Congress is never out of bounds in encoding in law the actual provisions found in the Bill of Rights, most especially the most important right of all, the right to life.

No State has the power to override God-given unalienable rights, period, ever.

This whole States' Rights attack is a red herring that I can't believe any conservative could fall for.

If Jeb Bush has the courage of his convictions then sometime tonight, state police will sieze Terry. Otherwise Jeb was just grand standing when he stated the DCF had the authority to place Terry in protective custity.

It would be nice to see a Republican do something right for a change, they are so good at talking the talk, but fall flat on the face when it comes to walking the walk. I never expect more then pretty words from Republicas these days.

Well some apparently have. But they are not so convincing, because they were upset thet the Florida Legislature tried to save Terri Schindler as well.

thx first i heard of this. but it goes with the territory her only hope is outside the judge/lawyer (insert your own) system. the human system has to take over.

I agree with you. When people really mean something they just do it, not make announcements or threats. Anyway, there's no time left for bluffing and manuevering, action is what is necessary. Jeb Bush, as Governor of Florida, needs to take control of this thing and send in the Family Services representatives with some State Troopers and take Terri to a hospital. Political fallout be damned, in the end he will be known as a hero. The media are calling his bluff by claiming all of America wants Terri Schiavo to die and don't want any political involvement.

Just a thought, but when a Governor (or President) pardons a person convicted by a judge or jury, isn't he in essence exercising his ability to override the ruling of a judge? Can't a governor intervene in this case by exercising some sort of similar power? I know I'm grasping at straws, but I just can't sleep knowing that this pig Greer is starving a woman to death and everyone in this entire nation is impotent to do a damn thing about it.
