Jeffrey Lee Parson, the Hopkins teenager who unleashed an Internet worm that infected an estimated 48,000 computers and caused more than $1 million in damage, should be sentenced to 37 months in prison, according to a formal recommendation made by federal prosecutors Tuesday.
Parson's sentencing is scheduled for Friday in U.S. District Court in Seattle. Parson, 19, who was arrested during his senior year at Hopkins High School, pleaded guilty in August to releasing the widely publicized Internet virus.
"Parson's worm was not an aberrant moment in a young person's life, but instead was just the latest in a string of escalating efforts by Parson to take over other people's computers, destroy their Web sites, and otherwise use his computer skills for his own selfish amusement, personal gain and/or to harm others," U.S. Attorney John McKay and Assistant U.S. Attorney Annette L. Hayes wrote in their sentencing memorandum.
Prosecutors then requested that Judge Marsha J. Pechman sentence Parson to 37 months in prison -- the maximum sentence under a plea agreement that suggested a sentence between 1½ years and three years and one month.

Given the facts as presented here, that sounds reasonable. Let's hope Judge Marsha's motherly instinct sees it that way.
He'll probably just get sent to Waseca, anyway. It's not exactly Leavenworth.
I read that too.
Normally, I'd say "Hey, this guy sounds like he screwed up. Make him pay restitution and have him do a s**tload of community service". That should take care of it.
But as the asst US attorney put it, this kid was malicious in what he did and he deserves the 37 months in a federal pen.
This is an outrage!
If it had been 37 months per criminal count I might reconsider my intransigent attitude.

Virus and worm writers/senders, spam senders should be tracked down and summarily executed; no trial or jail term.
He should get 6 months and 3 years of probation. Maybe some restitution. He's just a dumb kid learning about technology. It was a white collar crime. Violent criminals dont even get three years.
