Nearly Eight Years In Prison Without A Trial
"I want to go to trial on Monday; I've been locked up for nearly eight years," Dr. Tom Sell declared. "The federal court has no evidence, they have no witnesses. I want my trial one week from today. I am not incompetent in any way, shape or form." His statements rang true to bystanders attending his hearing on November 22 in the federal courthouse in St. Louis, Missouri. Whatever happened to the right of an accused to have a speedy trial?
Once a successful dentist in St. Louis County who treated many indigent patients, Dr. Sell was accused of Medicaid fraud in 1997. Although he has never hurt anyone, and a federal court held that he poses no danger to those around him, prison officials frequently placed him in debilitating solitary confinement for periods that totaled nearly two years.
Prison officials tried to drug Dr. Sell, allegedly to make him fit for trial, and the lower courts ruled in favor of mandatory drugging of this non-convicted, non-dangerous, non-violent prisoner. The federal government fought all the way to the U.S. Supreme Court for the power to forcibly drug Dr. Sell and, even though it lost its case there, the government continued to imprison and prevent him from receiving proper medical care.
The forced medication was designed to correct Sell's attitude towards the government. Sell seemed to think the government was out to get him, and the government wanted to drug him to get him to change his mind.
Is this occurring in the United States of America? Psychiatrists were frequently employed by the Communist Soviet Union to cover up atrocities and silence critics, but our veterans who fought against the communists in Korea and Vietnam never expected such tactics to be used by our own government.
Earlier this year, a government psychologist declared that Dr. Sell was mentally fit for trial. Apparently that medical opinion was not satisfactory to Dr. Sell's persecutors, and to everyone's surprise that government psychologist reversed his diagnosis without reexamining him, and declared Dr. Sell unfit for trial.
An independent psychiatrist then confirmed Dr. Sell's own view that he was fit for trial, and the court agreed and scheduled a trial for November 29. But on November 22 the lawyers insisted that he was not ready for trial and persuaded the judge to cancel it.
The lawyers argued that Dr. Sell is not competent to stand trial because he insists on talking about the abuse he has suffered in the prison which could be proved by prison videos that the government is keeping secret. The Association of American Physicians and Surgeons filed a motion for the court to release these revealing tapes, and the St. Louis Post?Dispatch also intervened to demand their public release.
But it appears that the government is doing everything it can to prevent a trial of Dr. Sell that would expose the record of this case.
In investigative reporting worthy of a Pulitzer Prize, Carolyn Tuft of the St. Louis Post?Dispatch revealed on November 23 some of the evidence on the still-secret videos. She reported that two videotapes of Dr. Sell show him being stripped, scalded, humiliated and brutalized in a way that sounds shockingly similar to the abuse of the Abu Ghraib inmates.
Is there no accountability for this type of government misconduct? Instead of investigating and punishing the wrongdoers, federal officials are moving heaven and earth to avoid a public trial that should expose the tapes and the fact that a man has been held in prison so long without a trial.
The only one in the courtroom making any sense at what should have been the final hearing before trial was Dr. Sell himself, who stood up to assert his constitutional rights. His plea was to no avail, as the judge ordered him to be shipped to North Carolina for yet another examination by a government psychiatrist.
By now Dr. Sell knows the game all too well, and he announced in open court that he would not submit to another sham mental evaluation. Nevertheless, he will now be transported across the country to find another government psychiatrist to deliver the desired diagnosis to save officials from public scrutiny.
We've all seen the pictures of Abu Ghraib, so why can't we see the pictures of prisoner abuse in the federal prison at Springfield, Missouri? Congress should demand the immediate release of the shocking videos showing the mistreatment of Dr. Sell and also order a full accounting of the taxpayers' money spent by the government to keep a man in prison nearly eight years without a trial.
Sounds more like the old USSR than the USA.

Torture and Psychological Abuse
Political ambition can be a powerful motivating factor for government abuse of our rights. Consider one of the cases that helped propel Janet Reno to national stardom. In 1984, Reno faced a serious challenger in her bid for reelection as Dade Countys state attorney. In August of that year, Frank Fuster and his wife, Ileana Fuster, were arrested for sexually abusing more than 20 children who attended their home daycare center. Reno began the case by soliciting Laurie and Joe Braga, both billed as child abuse experts with no psychology training, to interview the children.
The Bragas used suggestive and misleading interview techniques to elicit false accusations from the children in the case. The children were brainwashed with fantasies of sexual abuse involving masks, snakes, drills, and other objects, and eventually came out of the interviews thinking they were victims.
Of all the children alleging sexual abuse against Fuster, Renos office only presented physical evidence that one child was abused. The prosecution invoked a laboratory test suggesting that a child had tested positive for gonorrhea of the throat. However, the lab test that was performed is very unreliable and often gives false positives. Renos agents tested for the family of bacteria to which gonorrhea belongs rather than specifically for gonorrhea; other bacteria that could have caused the false positive are harmless and are frequently found to live in children. Of course, the state ordered the lab to destroy the evidence three days later, thereby preventing the defense from challenging the states evidence.
Recognizing that the case against Fuster was weak, Janet Renos final straw was to torture Ileana Fuster physically and mentally to the point where she could be coerced into implicating her husband.
Reno had Ileana isolated from the prison population and placed in solitary confinement, naked. Ileana described her treatment in a 1998 interview: They would give me cold showers. Two people will hold me, run me under cold water, then throw me back in the cell naked with nothing, just a bare floor. And I used to be cold, real cold. I would have my periods and they would just wash me and throw me back into the cell.
Late one night, the naked Ileana, according to her lawyer, received a visit in her darkened solitary cell from an intimidating 6-foot-2 woman. The woman told Ileana that she knew that Ileana and her husband were guilty. But how can that be? We are innocent, Ileana proclaimed. Who are you? Im Janet Reno, the woman said. Ileana repeatedly told Reno that she was innocent, and Reno kept repeating, Im sorry, but you are not. Youre going to have to help us. Reno made several more solitary, nightly visits to the naked Ileana, each time threatening Ileana that she would remain in prison for the rest of her life if she didnt tell Reno what she wanted to hear.
Finally, Reno hired two psychiatrists from a company called Behavior Changers Inc., who met Ileana 34 times in a one- onth period. These psychiatrists claimed to be able to help individuals recover memories, but their technique was simply to hypnotize Ileana so that she could be brainwashed into believing that Frank Fuster was a child molester. The coercion eventually worked: with the psychiatrists present and with Janet Reno squeezing her hand, Ileana implicated her husband.
Ileanas trial testimony against her husband put the final nail in Frank Fusters coffin. Reno won the conviction, her reelection bid, her name in the newspaper headlines, and a stepping stone to a position as the nations chief law enforcement officer. However, Ileana Fuster has repeatedly retracted her confession and testimony, swearing that she and Fuster never abused any of the children, and that her confession was the product of brainwashing.
Yet, thanks to Janet Reno, an innocent Fuster remains incarcerated for 165 years without the possibility of parole.

The government needn't bother with judges and psychiatrists anymore. Just declare Dr. Sell an enemy combatant and the game's over.

What I find thoroughly perplexing is the fact that most liberals think that John Ashcroft was a horrible Attorney General. Yet I have never heard anything that he did that was so wrong. The worst accusation was that he was somehow responsible for the Patriot Act.
However, the abuses from Janet Reno abound, and are specific. The most notable are Waco and Elian Gonzalez. The hypocrisy of this latest example is that Ms. Reno putatively wanted to protect children, but she killed over 50 of them at Mt. Carmel and almost another one when she sent jack-booted troopers in to kidnap Elian.
I was in South Florida then also. The Fusters were demonized in the Miami Herald etc as the worst demons ever to walk the earth. Satanic rituals, child torture, all of it. The Bragas were lionized as heros, the only "experts" who had a knack for getting traumatized children to "tell the truth" about their "abuse."
Others falsely imprisoned by these Bragas have been freed, in NY, NC and CA. But Mr. Fuster still rots in jail, an innocent man.
Just a handy stepping stone on Reno's career path.
Even if this doctor defrauded Medicaid, he should never have been treated this way, if the article is factual. Schlafly and the Eagle Forum are reputable. Just because someone has been accused of committing a crime doesn't mean they have every right stripped from their existence.
This psychiactric "evaluation" crap is sickening. It's one of the most effective ways to get rid of undesirables forever. The only people who should be incompetent to stand trial are those in comas, or cannot speak or understand human language.
It's amazing. Most of Reno's abuses (Fuster, Waco at least) took place when the MSM still had a near monoploy. I think today, a Reno type demon would be exposed.
But Mr. Fuster still rots in prison, for life.
I hope Lucifer is warming up a red-hot corner for Reno. I hope her death is long, slow and painful.

Between stories like this & ones on private property being taken through eminent domain by local governments....I am livid.
Yep, nothing like a forced psychiatric examination by government shrinks to destroy a man's ability to defend himself.

Always remember, Jim McDougal tried to blow the whistles on the Clintons and died in prison. Susan McDougal kept her mouth shut and walked away with a Clinton pardon.
The implications are pretty obvious.
