He is a smart and well-spoken, and young enough (56) to serve for several years with distinction. I don't know if he alienated democrats as the chair of the RNC, but I suspect he could be confirmed.
My back-up selection would be Orrin Hatch, only because there is no way Arlen Specter would vote against him. But his age (70+?) limits his potential legacy.
In the meantime, I hope Rehnquist has a speedy recovery and lives a long and fruitful life.

Hatch's age is a disqualifier. We need a young and healthy conservative who will influence the court for at least 25 years.

I agree, the younger the better. I have no idea how young would be too young from a strategic perspective.

Racicot is an excellent choice for President for all the reasons you listed.
Bush should renominate all the conservative judges the Demorats rejected, Owens, Estrada, et al. Make them eat crow.
Orin Hatch? He wants to blow up my computer remotely if he thinks I downloaded music (which I don't). Think I'll pass on that one and wait for somebody who understands due process.

Plus, I have to be suspicious that Hatch is in the pocket of the movie, music, and tv industry. None of which were particularly helpful to our cause this time around. If you are going to be bought off, at least be bought off by our supporters.

It might be Gonzalez. Miguel Estrada has been smeared by the Dems, especially that rat Schumer. Estrada does not want to risk his family in a vicious showdown with the Dems, so I'll say Gonzalez

Racicot is more of a political operator and self-promoter than a True Believer. He left the Montana GOP in shambles. He would be another Kennedy on the court, at BEST.
Racicot interesting idea. My best buddy has relatives in Montana. Every year we go hunting there and four years ago I asked some of them about him. I waited until massive amounts of adult beverages had beeen consumed. The room got very quite and the oldest uncle looked at me and said "He's a great Governor and a great guy - but he has skeltons. No more taling about it ok?" I have never been able find out waht they are but the consenus is he wouldn't stand up to the vetting.

I'd like to be convinced otherwise. One of his big faux-pas up here was his opposition to right-to-work legislation. He could have sheperded it through, and instead, Montana remains excessively union controlled.
He hand-picked his successor, and she was an utter disaster. Rather than building the GOP into a smart, efficient organization, he let it wallow in incompetence, and as a result, Montana just elected a Democrat governor, and the Dems took over both houses of the legislature. No excuse for that in a state that went 60-40 for Bush.
He was begged to come back and challenge Max Baucus for the Senate seat, and turned down the challenge.
Racicot did a good job for the Bush/Cheney campaign, and I'm grateful for that, but please, no Supreme Court for him.
There is a law professor in Montana -- Natalson -- who Bush does need to appoint to the federal bench, though.
