Governor McGreevey has announced his resignation, effective November 15. If the effective date of his resignation were only one day earlier, the people of New Jersey would elect their new governor on Nov. 2. The selection of November 15 and not any earlier date is clearly a sleazy maneuver which will elicit calls for his immediate resignation, and/or for his impeachment (assuming that the NJ constitution contains such a provision).
But it is only August 13. When it comes to the right of the citizens of the State of New Jersey to elect their governor, the difference between November 15 and November 14 for the effective date of resignation date should, at this early date, be beneath the law's notice.
The precedent could not be more clear. In the celebrated case where Torricelli was replaced on the ballot well after the legal deadline for doing so, McGreevey and the Supreme Court of NJ placed themselves on record that a deadline in law is negotiable.
Suit should be brought on behalf of the Republican voters of NJ to allow them the chance go elect a candidate for Governor. Just as suit was successfully brought on behalf of the Democratic voters of NJ to vindicate their "constitutional right" to a candidate with good poll numbers on the 2002 Senate election ballot.
PING.
BTTT!!!!!!
I like it. Sue the dems in jersey. Elect a Republican. Put the grownups in charge.
Float a rumour that the Lt. Gov. is a closet conservative, that might stir things up and begin a demand for elections.
This is what I posted on the McGreevey thread yesterday:
Time to take this to the NJSC. He's announced his resignation, and the date of the resignation doesn't matter. The purpose of the 60 day special election window is to allow enough time for the people of NJ to make an informed choice of who their Governor will be, not act as a wall to block the will of the people.
The NJSC has already ruled that the right of the people to have a valid choice in an election overrides any laws about timing as long as it doesn't impact the execution of the vote itself. A case could be made that the people of New Jersey deserve a choice about who their next governor will be.
At least bring the case before them, and let the NJSC worm their way out of it (Doug Forrester, are you reading this?).
From what I understand, it's not 11/14, but any date prior to 60 days B4 11/2 that would require a gubernatorial election this (as opposed to next) Nov.
There is no Lt. Governor in New Jersey. If the office of Governor is vacant for any reason, the President of the New Jersey Senate assumes the role. He is a Democrat.
This is way to get rid of McGreevey who is a liability, and promote a Democrat to take his place, without asking the will of the people of New Jersey.
Impeach him! Someone file charges that he has disgraced the Office of Govenor, Abused his Power by appointing his boy toy to a position out of his sexual relationship and committed Illegal acts while in office.
LOL!Love that line, love the whole reply. I knew others would think of it, and did a scan to see if it was obvious that anyone had created a thread on the idea.
The Scumocratic Party of New Jersey has swallowed its camel.
Let's see them strain at this gnat!
60 days prior to November 2 is September 3. This is three weeks from today. People need to move fast on this.
Actually, he needs to vacate the office before 60 days prior to the general election on Nov. 2, in order for an election to be held for a replacement to fulfill the remaining time in the term.
So he has to resign now.

Sixty days, smixty days, doesn't matter. What matters is that the people of NJ get to elect their own Governor, whether a deadline is completely blown or not. That's what the Supreme Court of NJ said in '02 (well, what it really said is that the Democrats of NJ were entitled to a candidate on the ballot who had good poll numbers).
He should resign immediately! November 15? What for? It shouldn't take him that long to clean the gay porn out of the governor's office. Who in NJ is going to bring this case however?
I'm a betting man and I would bet that you aren't very familiar with the New Jersey Republicans.
You are, of course, correct.
Nevertheless, the argument is stronger the sooner it is presented. Legal delays could easily make this a moot issue.
We don't have a lieutenant governor.
