We left CA in 2010, and there was serious talk about an Exodus Tax even then. Forcing someone to be trapped where he doesn’t want to be ... isn’t that kidnapping or similar?

because you were a md resident for 5 years and didnt declare florida your home state before moving.

ie. you buy a 2nd home in Tennessee and are going to retire there, you want to take advantage of tn state tax rate for work. but you live in md. so you declare on your md taxes you are an out of state resident. = no md state taxes, but when you sell your md home, you have to pay 7.5%. to maryland to complete your home sale. also works if you have a rental property and you live say in Virginia.. . you have to pay the state tax sell it.

I got one from CA a year after I left.
It was easier to pay than fly back to CA to fight it.

Good luck collecting taxes from people who are residents of other states. Doing so would depend entirely on the AGs of those other states. They tried this before and Nevada’s AG told them to go pound sand. I don’t imagine they will be any more successful this time.

I have heard that NJ has a tax on the sale of property that is refunded if you buy more property IN the state and not refunded if you buy property outside the state.

assuming that all in-state California assets have been disposed of and/or transferred to other states prior to exiting, there’s no enforcement mechanism possible ...

presumably though, the California ex-patriots themselves have lost their California visitation privileges ...

nonetheless, it’s nice that California has announced their intent for an “exit” tax, so those who wish to flee can properly prepare for their exit ...

still, one would think an “exit” tax would be unconstitutional under the commerce clause, though most of those contemplating fleeing would probably rather just flee instead of becoming embroiled in a VERY lengthy and VERY expensive legal journey ...

California has been talking about doing this for a while now. Other than this article, I haven’t seen any news about it becoming law..

their computer isn’t very persistent ... i still get forwarded property tax notices from a county in another state regarding a tiny two-room apartment my deceased father owned there at one time but which has long since been sold ...

after MANY years of such tax notices, the total (including mostly “penalties”) is over $300,000 ... it’s amazing what compounded interest can do! ... still, it’s intriguing that they apparently haven’t attempted to file tax liens against subsequent owners ... oh well, not my problem ...

I would presume in the same manner that the IRS attaches liens against someone’s property to secure payment of “unpaid taxes”. It doesn’t have to be legal, remember... if it’s a Democrat or Democrats doing it.
