My personal theory is that the more staunch a person is, when it is safe to do so, the more likely they will fold when the chips are down.

Well, this is obviously tactical. Ellis knows she can't win at trial now in that court. So, having negotiated a plea deal, she can file a collateral attack later with the benefit of knowing what the maximum penalty is. The way the system works is that the prosecutors overcharge criminal defendants to force a plea deal. Ellis suffers a loss of face with the plea deal, but like Mike Flynn, she could win in the end. In short, our dysfunctional criminal justice system causes this. I feel sorry for her. She did nothing wrong and tried to save the Republic. If Trump returns to office, she should be nominated to be a federal judge.

It depends on vacancies, but Trump is rewards loyalty. He could nominated her as judge for a U.S. District Court in Ga, The United States Court of Appeals for the Eleventh Circuit, or even SCOTUS. We need to get him back in office first for that to happen.

The whole U.S. criminal justice system now works on plea deals. The prosecutor overcharges the criminal defendant, then except in the most heinous cases, offers a plea deal. The criminal defense attorney has an ethical duty to present that deal to his/her/its client. Defense attorneys benefit from those deals because it enables them to take more cases than if they all went to trial. A bad criminal defense attorney will cut back room deals contrary to the client's instructions. It's unethical, but many will do that. Not taking the plea deal can annoy the judge, who could impose a harsher sentence if the matter goes to trial.

The plea deal is a known quantity, which also saves the defendant the expense of his/her attorney. Taking the plea deal doesn't prevent the defendant from later attacking the sufficiency of the evidence, the jurisdiction of the court, prosecutorial misconduct in withholding exculpatory evidence, etc. As with Gen. Flynn, it can avoid additional expense and a harsher penalty. Innocent people do get bullied into taking the plea deal, often.

And how many men have folded the same way when they became targets? Don’t forget Michael Cohen who once claimed he would take a bullet for Trump and ended up a turncoat. And there was John Kelly. I remember thinking that it seemed every week there was another Trump appointee accusing Trump of heinous doings.

That's not true in general. A plea deal almost always ends any opportunity the defendant has to raise any issues or defenses.

like I said, it’s really easy to tell other people what to do, when you aren’t facing 20 years in prison, financial ruin and you still have decades to live, when presented with an opportunity to put it all behind you and go on with your life.
