There is no way to determine proximity to use. Alcohol is out of the system overnight. THC stays in the system for a long time.

Not saying this person wasn’t high when the accident occurred, but saying someone “has marijuana in their system” tells us absolutely nothing to the person’s state of mind at the time of the accident.

I’ve been off of pot for over a decade, but I’m fine with people smoking if they can be responsible with it. As a recovering alcoholic, I have issues with substances, so I abstain from it all. To each their own.

I am against pot legalization, but you are correct. There is also no shortage of 16 year old drivers exercising poor judgment when not impaired. With six in that tiny car, she might not have been able to turn her head to see properly. I would maintain that packing six in a Spark is prima facie evidence of habitual bad judgment. Rest in peace.

I agree. But in this case, it is relevant if the *other* passengers had it in their blood as well. If several of the others had it, it increases the odds of their have recently consumed it, and thus impairment.

After coming of age during the 60s and seeing it all in friends and acquantances, I would say that MJ, like alcohol, affects different people, at different ages, differently.

I have very productive intelligent people I know that have used it occasionally for fifty years with no problems. I have other people I know that used it and became unproductive wastes of space for the rest of their lives. Same with alcohol although the recovery from alcohol misuse seems to be very positive and permanent for some.

I don’t think we can predict how it will impact us so I think counseling caution and avoidance is worthwhile.
