Of course, nowadays anybody can file a nuisance lawsuit.

One of the many ways the American experiment went awry is that somewhere along the line judges began allowing frivolous lawsuits that should have been thrown out on their face.

Exactly. Also, judges have incredible power and make decisions on matters that should not be their concern.

This could easily be remedied by instituting a requirement the plaintiff in a civil suit pays the legal fees of the defendant if the plaintiff loses the case. In class action cases the attorneys bringing the case should pay the defendant’s costs if the class action suit is unsuccessful. These requirements would dramatically reduce the number of lawsuits and would virtually eliminate “lawfare” where frivolous suits are filed in order to extort a settlement from defendants of less than the cost of defending the suit.
