I totally agree with you. The judiciary as a whole has way, way overstepped their constitutional bounds. I don’t know exactly when that started to happen, but it became a runaway train over the last couple of decades.

This could easily be remedied by instituting a requirement the plaintiff in a civil suit pays the legal fees of the defendant if the plaintiff loses the case. In class action cases the attorneys bringing the case should pay the defendant’s costs if the class action suit is unsuccessful. These requirements would dramatically reduce the number of lawsuits and would virtually eliminate “lawfare” where frivolous suits are filed in order to extort a settlement from defendants of less than the cost of defending the suit.

The Constitution gives Congress the power to define the role of federal courts and the judges administering cases. Congress chooses not to do so. As a result the leftist judges are constantly pushing the boundaries of permissible behavior.
Don’t count on Mitch and Kevin to look at reforming the federal courts should the Republicans win both houses of Congress.
