Irwin Schiff (tax protestor and patriot) would have been 91 yesterday

BIOGRAPHY

Irwin Allen Schiff (February 23, 1928 – October 16, 2015) was an American tax protester known for writing and promoting literature in which he claimed the income tax in the United States is illegal and unconstitutional. Judges in several civil cases ruled in favor of the federal government and against Schiff. As a result of these judicial rulings, Schiff was serving a sentence of at least 13 years for tax crimes at the time of his death. The Federal Bureau of Prisons reported that Schiff died on October 16, 2015. Schiff was the father of businessman and former United States Senate candidate Peter Schiff.

BACKGROUND

Schiff was born to a Jewish family in New Haven, Connecticut. His parents were immigrants from Poland and his father worked as a carpenter. In 1950, Schiff attended the University of Connecticut where he obtained a B.S. with a double major in Accounting and Economics.

After college, Schiff was in the insurance brokerage business in Connecticut. In connection with his business, he was involved in a tax shelter in which he became the victim of a Ponzi scheme in which he lost money belonging to him and his clients. In 1968, he testified before the Senate Committee on Banking and Currency in opposition to the removal of gold backing from Federal Reserve Notes. In 1976, he published a book entitled The Biggest Con: How the Government is Fleecing You.

Schiff was a candidate for the Libertarian Party presidential nomination in 1996, and he participated in a Libertarian presidential candidates debate in Washington on July 5, 1996.

Schiff had a web site named "PayNoIncomeTax.com," which offered his various books for sale. He was featured in Hollywood producer Aaron Russo's 2006 film America: Freedom to Fascism.

ARGUMENTS RAISED BY SCHIFF

Among the arguments raised over the years by Schiff:

1. That the Internal Revenue Service, in enforcing the income tax, seeks to impose a tax not authorized by the taxing clauses of the United States Constitution;

2. That no statutory deficiency in Federal income tax can exist until an assessment has been made;

3. The filing of income tax is voluntary, and "voluntary compliance" is a misleading phrase used by the IRS to mislead the public;

4. That no tax assessment can be made unless a tax return has been voluntarily filed;

5. That the United States Tax Court has no jurisdiction over him; and

6. That the United States Tax Court is not a legal court, but is instead a part of the IRS.

These arguments were ruled invalid in Schiff v. Commissioner. Another argument made by Schiff on his web site is: "On the [Form] 1040 itself... you report 'zero' income regardless of how much you received in: wages, commissions, interest, alimony, capital gains or from operating a business. For tax purposes, 'income' only means corporate 'profit.' Therefore, no individual receives anything that is reportable as 'income'." This argument has been rejected by the lower courts, as well as the United States courts of appeal. See Cameron v. Internal Revenue Serv.; Stoewer v. Commissioner;Reinhart v. United States;Fink v. Commissioner;Flathers v. Commissioner;Schroeder v. Commissioner;Sherwood v. Commissioner; and Ho v. Commissioner.

The income tax is on its face unconstitutional. I could point out half a dozen obvious reasons why and at least 100 secondary reasons. Let’s start with jurisdiction, shall we?

RandFan: Your epigram about I Schiff is excellent.
Schiff may have been technically correct; at least he had some compelling arguments.
Also, he himself believed he was legally correct.
And he likely thought he was morally correct.
Further, having been scammed in a Ponzi scheme he was possibly suffering PTSD from that event.
It is sad to see the underdog get squashed by the system.
Even so, admiring this man seems a little bit much.

Thanks for posting.

People should take a stand against income tax. We should be taxed for:

1. Military (to defend our borders)
2. Police (to ensure domestic harmony)
3. Some business and bank transactions
4. Government maintenance and oversight

And that’s it. You should NEVER be taxed for your personal income. (And look what they use this precious money for! They GIVE IT AWAY to foreign countries who hate our guts and create an entire culture of people who DON’T WORK or contribute anything to society and who get really angry if they don’t get their free handouts.)

EXCELLENT BOOK !!

Great insight: The "assets" in the Social Security Trust Fund held in Treasury Notes and Bonds are merely evidence that the money collected for Social Security was already spent on something else.

I think they missed the point that the income tax could not be extracted from wages. And Glenshow glass basically changed the definition of income to be appurtenances to wealth. When your life is assigned as a commodity. recent supreme court justice equated your work at a company the same as a machine that might go haywire to enforce vaccine mandates.

Income taxes reward sloth and crime, while punishing productive, “reportable,” work.

When half of a population do not pay a major tax, they have complete encouragement to grow government (to help them) by increasing taxes they never pay (on workers).

My wife and I have no plans to ever move to a state with a state income tax. We have our targets only on states without them.

Sales taxes encourage wise buying while assuring everyone pays something into the community tax pie. They also don’t require onerous filing expectations with everyone, save for businesses collecting them.

It is voluntary. No one forced you to get a Social Security number. But when you did you became effectively connected to the federal tax scam. Erwin Schiff knew just enough to get himself in trouble. He didn’t understand that the way to avoid the income tax was to not sign up for Social Security benefits in the first place.

Every time you sign your 1040 under penalty of perjury and a maximum two-year sentence you do so voluntarily. But the constitution clearly states that she cannot be forced to be a witness against yourself. This is just one of the many obvious unconstitutional aspects of the income tax.

A court ruling?

Look at the case of Alecia Pennington in Texas.

Born at home, midwife didn’t file birth certificate, homeschooled, and when she went to apply for driving license, get a job, and go to college, couldn’t do anything because she couldn’t prove she was born here.

7 of my kids were born at home. They didn’t get a birth certificate at all, but at some point we did obtain a document from the state of Indiana (I don’t remember the name) so they could go on a cruise. People who say “you have to have this or that” usually don’t know what the hell they are talking about.

What happened when they went for their drivers licenses, applied to a college, and applied for a job?

How did they prove their age for the driving license?

How did they prove they were born in Indiana for in-state tuition, if they went to an Indiana college?

How did they prove their age and citizenship for the job?

Did the Indiana document suffice for this?

Was this before the draconian ID requirements put in after 9/11?
