But not for the reasons you may think.
There’s been a lot written about the power Vice President Pence has to turn the stolen election around on January 6. Many commentators on various sites (including AT) have weighed in, some expressing hope, while other have expressed doubt Pence would do the right thing.
But it appears all of this is moot, as Bill Jacobson, founder of Legal Insurrection writes:
A claim has circulated widely in the past few days that Vice President Mike Pence, as President of the Senate, has the power and discretion to reject certifications. If Pence had such power and chose to exercise it, it would be over, but he doesn’t.
Jacobson cites relevant language from the Constitution (Article II, Section I, after the 12th Amendment) to support his assertion and then summarizes.
Note the words. “Shall … open all the Certificates” and “the Votes shall then be counted.” Shall is mandatory, there is no discretion. The certificates must be opened by Pence, and the votes must be counted (it’s unclear who does the counting, but the votes must be counted regardless). No Vice President (whether Mike Pence, Al Gore or future VP Kamala Harris) performing the function of opening the votes has discretion to reject votes. No Vice President has authority to accept votes presented through some extra-constitutional other process.
There is an interesting legal question of what would happen if a state authority presented conflicting votes — for example the legislature certified one set of electors but the executive branch certified a different set — but that has not happened here. No state authority has certified more than one set of electors.

If so then we are screwed unless states can withdraw their elector votes. Or maybe if everyone committing fraud ends up in jail, but the FBI would probably step in to block that from happening.

None of the Republican controlled legislatures of the states of GA, AZ, MI, PA and WI have shown any interest in withdrawing their respective electors and replacing them.
We’re on our own folks. Praise the Lord and pass the ammunition.

This is what I have been saying all along. Talk was cheap, but only they have the power to dispute the electors.
No one knows what will happen with Pence on Jan. 6. Not interested in yet another news site pundit’s opinion.
I think Pence read the tea leaves and saw that he has no chance in securing the 2024 nom as an Establishment-lite pol after 4 years of MAGA, and wouldn’t be able to compete against the young blood likes of real conservatives like DeSantis and Noem, so he has nothing to lose, and will still be popular among the DC swamp rats.

If the steal stands, NO Republican will win in 2024.
Conservatives in Venezuela thought the first term of Hugo Chavez would lead to a wrecked economy (it did) and an election win for the conservatives.
Fatal mistake. There was never another fair election where conservatives could win.
Ditto for the USA.
And don’t forget the 20-30 million illegal aliens who will be given amnesty and Rat voter card, who will be voting in 2022 and forever.

This is when we have a contested election. All envelopes are opened and then the opposition states they are contesting (swing states). Each state will get time to present evidence not to exceed five minutes. But not to exceed two hours of debate total. Then each house will vote. Obviously the house is controlled by the Dem’s and the Senate Pub’s. The only hope we have is the evidence is so overwhelming that it will be a non-partisan vote. Both sides are in negotiations on how this will proceed. Can they yield their time to another etc.
This is why I believe Trump needs to go nuclear before January 6th. Epstein or Robert’s level of nuclear. Needs to shock the world type of disclosure.

And unregulated mail-in voting will be allowed everywhere.
Who would try to stop all that? Not Biden. Not Congress. And certainly not the media. Our only hope would be with the Supreme Court. And so far, they seem uninterested in this.

Exactly. “Winning” will depend on who’s spinning the “Voter Fraud Knob”. Right now...and well into the future...it’s the Left.
I’m not sure why some folks on the Right think we can win “this” or win “that” politically in 2022 or 2024. There will be no more winning for the Right.

This is Trumps election. Either he prosecutes the fraud or he doesn’t.
Barr did exactly as Trump asked him. They just didn’t anticipate the fraud machine Joe put in place. Those are the facts. Stop gumming this thing and look at the facts. 75 million voters will fight on and keep the left from wrecking the country.......

We loose, then the outcomes are going to be for all the marbles.
There is no diplomatic or moderate speach talk nor any religious call for calm and civility.
That moment passes as soon as the gavel drops at the close of the 6th. If you expect anything different you may not like it how history records the plight of those who waited for things to get better by just hoping they would. Not defeatist, I am a realist who has travelled to many places that fell to socialist or Communist rule, worked in some, and all my life have studied histories of conflict.
