“He probably asked for a continuance.”
..............................
It will be denied.
**************************
It sure will be denied. If the Dumb ass Sullivan didn’t know ON WHAT LEGAL BASIS he decided to do what he did WHEN HE DID IT, he doesn’t deserve more time to try to MAKE UP A LEGAL BASIS.

Every defendant in every case brought by the Federal government will affidavit him off their case for cause. The DOJ might do the same.

Sullivan may soon be a judge without any cases to be heard.

Blacks are all about justice. Imagine if this had happened to a black man.

He probably asked for a continuance.

I hope not.

He must know that any delays violate Lt. General Flynn's sixth amendment rights to a speedy trial, whose case has been going on for several years now.

Delaying yet again for this judge's personal predicament would be more cruel and unusual punishment for Flynn.

If Sullivan were to insist on a continuance, I'd hope that would be grounds to remove him from the case while his own proceeds, so that Flynn can move onto closure with his own case.

If denied, Sullivan will say it was a racist decision because he is black.

The current strategy of The Resistance is to drag this out as long as possible.

All filings in Federal court are done electronically through an ECF account. Most are available on PACER almost from the moment they are filed.

Not quite true that a judge can only be removed by impeachment process.

Removing Federal Judges Without Impeachment

However, it is still quite hard to remove a judge, especially based solely upon a decision he delivers.

“Only the US Senate can remove him and that requires 2/3. It also requires a majority vote in the House. His job is not likely threatened.”

Ouch! You are right. State judges can be retired or fired, but Federal District and Appeals Court Judges can apparently be about as incompetent, partisan, and biased as they like.

I don’t see him getting a continuance. These writs are not designed to drag out. He should have had his ducks in a row going in. You don’t pull the kind of stunt he pulled, then when you’re called on it, go “Gee, I wonder how I can justify this.”

“Not due until the tenth”
***************************

THIS IS THE JUNE 1ST DUE DATE ITEM:

“...A three-judge appeals court panel ordered the trial judge overseeing Flynn’s case, Emmet Sullivan, to explain by June 1 what the court should do with Flynn’s emergency request to force the dismissal of his case.

The Justice Department, which is seeking to drop the lying charge to which Flynn pleaded guilty, is also allowed to chime in, the appeals court said.

Thursday’s order comes from three judges on the US Court of Appeals for the District of Columbia Circuit, two of whom have recently sided with the Trump administration in cases related to the Mueller investigation....”

He can’t provide something “Privately”. He’s going to file it electronically, and then anyone with a PACER account [Public Access to Court Electronic Records], which anyone can get [and they’re not even expensive, though not free] will be able to pull it up.

Not due until the tenth

Not due on the "tenth," it was due "ten days from the date of the order," which was ordered on May 21, 2020.

No federal judge has been removed by any process but impeachment.

The professors who wrote the article you linked stretch the constitution to suggest congress COULD pass a law to allow their removal without the impeachment process.

But it’s certain that would not pass “judicial review”.

Lawyers can work from home. Its all about billing. I know of one lawyer who billed for 25 hrs in one day. He eventually was disbarred.
