Smoking Gun Paperwork In DA’s Case Of Crooked Dealing To Drop Cases

Waco – Dallas lawyer F. Clinton Broden wants this guy Abel Reyna. He’s got the facts, and the facts say there is a federal investigation underway, looking into the legal ethics of the sitting elected Criminal District Attorney, who is accused of political opportunism in his quest to prosecute members of the biker community, namely Matt Clendennen, former Scimitar, who was busted on May 17, 2015.

It’s true. We have the paperwork to prove it. In a protracted series of appeals to the Attorney General of Texas’ Open Records Division dating back to the summer of 2015, we of The Legendary obtained an example of a smoking gun left in the record by an assistant prosecutor named Joe Layman. Before he left under a cloud, fired by Abel Reyna, he noted on a disposition sheet that a certain party’s case had been dismissed because he made a political contribution to the campaign war chest of the DA.

There have been issues with this story from day one. Many have not wanted to see the issues, slowly they are coming out.

“Crooked politicians” is a redundant term, and includes judges too. It’s the best argument for smaller and less powerful government.

No question Reyna is dirty. Filthy dirty and he’s not alone. This would be a good chance for that area to clean up its own back yard and start fresh. Unfortunately it will probably cost a fortune in civil litigation and needlessly ruined lives.

If someone has to commit fraud and lie to go up the ladder in the DA’s office; that entire infrastructure needs an overhaul. There’s nothing worse than a good old boy club in the legal system. Justice is what they say it is instead of the law.

Reyna was also involved in the case of the Baylor basketball team murderer. Reyna and the judge were both Baylor law school grads and they arranged for a quiet plea bargain to keep the corruption on the part of Baylor out of a public trial.

Really? How so?

Anyone who has been paying attention to this boondoggle knows a lot of people were wrongly arrested and detained costing them who knows how much and how many lost jobs not to mention the stigma that goes along with being accused of felonies they didn't commit.

Then there are the families and friends of these people who were affected in varying degrees and it just keeps dominoing outward like ripples on a pond and for what; so some DA could get a promotion instead of the jail time he deserves?

I'm sure there are those who disagree and that's fine but it doesn't change the facts of this case starting with the blanket charge of 180 people; most of whom were not involved in the melee.

Anyone who has been lying attention knows that 200 gangsters were involved in a gunfight on a Sunday at a family plaza putting church-going women and children at risk of death.

Only 12 out of 154 firearms, Princess.

That's less than 10%.

So much for the "200 gangsters ...involved" (in a "shootout") part of your (and McLennan County DA's) theory. And it's been that all encompassing aspect that myself and more than just a few others were alarmed about, and have raised objections concerning.

As physical evidence indicates (corresponding to what can been seen on various videos) there were not "200" actively involved in a gunfight. Most of them were doing what would be logical in the circumstances, and running away.

That means the kind of statement you made in comment #9 was more like pure garbage than it was close to being truth of the matter.

Another potential problem for the prosecution here is that so far none of the 12 firearms (that have been matched to casings, or else bullets --including bullet fragments-- I assume) have been connected to any particular individual.

There is another problem too. The waitress's testimony (the one who said she saw a man wearing a yellow motorcycle helmet fire the 1st shot) contradicts police testimony (from 2 officers I think it was) that agreed that "a man with a bald head" fired the first shot (and was among those shot dead by the police, I think).

Nothing yet directly ties Carrizal to a firearm. Maybe the prosecution will get to that next Monday??? That is indeed possible -- but why the wait? And why did the prosecution not tell the jury in opening statement that they had that kind of direct evidence against Carrizal? The trial could have been over by now, if they had...

They'll need to somehow put a gun in Carrizal's hand, better than one witness saying "a man with a yellow motorcycle helmet" to eventually, as you say, have "a noose" tighten around Carrizal's neck.

Will Reyna (who is presently requesting the Court take himself and his DA's Office off the case against yet another defendant, Clendennan) ever get around to tying various things more directly (including deliberate conspiracy) to Carrizal -- or not? This case was one in particular the prosecution thought they had in the bag. I'm not convinced yet that the jury will unanimously buy what the prosecution is selling. Gotro is giving them a run for their money. All she needs is one holdout among the jury and the judge would need to declare a mistrial. In the least, it appears Gotro has gathered abundant grounds for future appeal (in case of conviction of her client, who I understand she took on pro bono).
