The New York Times asks court to toss Sarah Palin lawsuit

The New York Times has asked a judge to toss out a defamation lawsuit former Alaska governor Sarah Palin filed against it.
The newspaper said in court papers late Friday that its prompt and full correction of an editorial that referenced Palins political action committee nullifies her claims.
Palin sued the Times in Manhattan federal court last month, saying the newspaper had accused her of inciting the mass shooting that severely wounded then-Arizona U.S. Rep. Gabby Giffords. She sought unspecified damages.

Considering that the editors and ownership of the NYT, like everyone else, knew years ago what led the shooter to his actions, it could be nothing other than malicious intent to harm behind their printing the story.

You can retract your words but the damage was done. If you want to avoid future lawsuits, you watch your words.
If I flipped off a police officer and later said to the judge that, “I didn’t mean it,” the damage was done. I would get the punishment.

I read their correction at that time, and it definitely did not specifically state that there was NO LINK BETWEEN PALIN AND THE SHOOTING OF GIFFORDS. It was a half-assed correction, made only AFTER there was talk of a lawsuit. But, given the liberal judges sitting in all most every court, they will probably toss the suit.

the suit can only be dismissed if none of the stated facts are in dispute.
Whether or not what the NYT issued constitutes a retraction will determine if the suit is dismissed.
