Neither the individual mandate nor the employer mandate have been repealed. The penalty amounts have been set to zero, yet the mandate and the structure remain.

Why does the mandate remain?

Senate says they are not even going to vote on this House bill; they are going to write their own.

Maybe, duelling legislative chambers will come up with a better result in the near future.

The Bill is being handled as reconciliation which requires only 51 votes. To remove the two mandates would violate the Byrd rule against extraneous matters, not a budget item.

By setting the penalty at zero it has the same effect but can withstand the expected Dem attempt to remove it.

Many Senate rules, terms and procedures make little sense but must be followed exactly to keep this from a 60 vote requirement.

This is like a horse race, folks like a pretty horse but give me an ugly one that can run.

Each house makes their rules.

There is no requirement that reconciliation be used. There is no requirement for the “Byrd rule”.

They’re not playing to win, but dragging it out for years.
