John, a student at Okeechobee Achievement Academy in Okeechobee, Florida, was arrested at the school last week for felony battery against a paraprofessional in an October incident, allegedly punching and kicking his paraprofessional, which left scratches and marks, according to an incident report from the Okeechobee County Sheriff’s Office.

The incident occurred after John was being disruptive in class, throwing paper balls around the classroom and hitting other students, the report said. His paraprofessional asked him to go to time out. When John refused, the paraprofessional attempted to remove him, and that’s when John attacked, the report said.


Maybe the kid’s violent assault and battery — hitting other students, punching, kicking, leaving scratches and marks — is what got him into trouble with the law.

Pay attention! He was arrested for battery against the paraprofessional. In other words, as it seems to me, he resisted the paraprofessional attempt to restrain him.

You know what? I had that job once. I got scratched. I didn’t complain.

Funny as the kid is being arrested he’s screaming “I don’t like being touched” and the mom is saying “he’s autistic he does not like being touched” Yet he did a lot of touching of other people while in class. Strange is that not?

Words fail me in this case. I can not imagine any rational explanation which would result in a 10 year old being removed from school grounds in handcuffs months after the incident.

So I have to assume it is irrational; that the school was so fearful of a lawsuit that rather than suspending the student or even expelling them, that they believed this was a rational manner to resolve it.

You need a ten year old down at the police station, you inform the parent. That ten year old doesn’t show, you send the officers to arrest the parent. No where in this mix is there a path to removing a student that young from the school grounds in handcuffs.

Next they'll be arresting two year olds for having temper tantrums.

Maybe..
But a fact, not maybe, is this school is for kids like him with problems and they should have known how to deal with him.

Plus the incident happened in Oct.
They decide to arrest him so they went to the school out of the blue and arrested him.
According to the parent, with out any paper work.
They could have come to the home any day after the Oct incident and achieved the same result and also informed the parents of what was about to happen..They did none of this.

I hope the parents have hi power lawyered up and shove it up the towns ass

This is my hometown. There is much more to this story than what is being reported. The school the child attends is a specialized school for students who have demonstrated behavioral problems and the staff at the school are trained in dealing with children with autism. On the day this happened, the child had returned to the school after being absent for an extended period of time and he was there to take a test that would have taken an hour. He was acting up that day and had been in the school for an hour and fifteen minutes and they weren't able to calm him down enough to take the test. The arrest was the result of an assault that happened prior to this and the teacher's injuries were far more than what is being reported. I cannot verify but what I have heard is the teacher's foot was broken as a result of the child stomping the teacher's foot

There is video out there of this child at the time of the arrest. It's rather shocking to listen to this child speaking to his mother. Okeechobee is a very small town and like most small towns, word travels fast here. What you all are hearing is very one sided.

Kids with autism can “lose it” and not be in control of their bodies when upset.

Because of that, they need to NOT be mainstreamed until and unless they have found ways (even using their aide) to prevent losing it completely and giving in to flailing and hurting others.

As a mom of special needs kids, I do not believe any kid with potential violence should ever be mainstreamed, for the sake of others. Once the kid has been able to be in control even during disappointments, then I’m all for it, with strong big male aides.

Poor kid. They should never have arrested him. Horrible situation.
