Wagner’s 87 years old. Even if they indict him, his attorneys would drag it on so long he’d never see the inside of a jail cell. Not to mention the difficulty in trying a 40 year old murder case.
At best, this is a manslaughter case. The most a prosecutor could show is that Wagner pushed Wood, but didn’t realize how close to the edge of the boat she was, when she was pushed over.
