A federal judge has asked for additional safeguards in a landmark settlement between the NYPD and Muslims who sued the city over the department’s controversial surveillance practices.
In January, Mayor de Blasio agreed to appoint a civilian lawyer from outside the NYPD to oversee the department’s counterterrorism activities as part of a compromise to settle two lawsuits accusing the city of violating the rights of Muslims in the years since 9/11.
But Manhattan Federal Judge Charles Haight said the proposed settlement fell short of its stated goals, especially for a police department that had become “accustomed to disregarding” court orders.
“The proposed role and powers of the civilian representative do not furnish sufficient protection from potential violations of the constitutional rights of those law-abiding Muslims and believers in Islam who live, move and have their being in this city,” Haight wrote in his ruling Monday.
The New York Civil Liberties Union filed a Brooklyn Federal Court suit in June 2013 charging the Muslim surveillance program targeted people based solely on their religious beliefs.
The lawsuit named then-Mayor Michael Bloomberg and NYPD Commissioner Raymond Kelly as defendants.
In his ruling, Haight asked the two sides to clarify the authority of the civilian representative to ensure the NYPD’s compliance with the “Handschu Guidelines” — which governs the department’s surveillance of political and religious activity — and report periodically to the court.
