I don't know if the courts deal with this sort of question on an industry by industry basis, but for the most part, the fact that an activity is wholly intrastate does not preclude federal regulation. All activity affects interstate commerce, and that is the hook that courts use to uphold the regulations. A fellow by the name of Reynolds built a gun in his basement, never sold it or offered it for sale, and he was convicted of a federal firearms offense (California) under the rationale of Raich, which makes home-grown pot a federal offense.

They will get around this by not selling complete vapes. All they have to do is sell the battery pack, the coil and the tank as separate pieces. Same with flavors. They will sell the liquid separate from the flavor. They already sell the nicotine separately.

This is why it started w/tobacco (actually, it was alcohol but we know how that went). Tobacco use is avidly hated by many, hence the onerous rules pass easy.
What else is there other than smokes and fatty eats?
-Sexually transmitted diseases, including those that lead to cancer. How about an AIDS tax on that gay marriage license? If Billy Graham gets in office, you might have that.
-Contact sports. Rare are those paralyzed for life but when it happens to an adolescent, that’s a long time to pay up. Also, a million one dollar claims costs as much as a single million dollar claims. Physical therapy for relatively minor sports injuries is a multi billion dollar industry due to the volume of clients.
-How about living near a city? Increased pollution rates mean increased respiratory illness. You are not “well enough” if you live in town so special tax for you!
-Like to hike, climb mountains? Sorry too risky to walk on unpaved paths. Not legal - for your own good.
Any of the above and more can be justified w/the same argument as tobacco - statistically, use increases risk. Not a guarantee of illness. Just better odds. All can be enforced through wellness requirements.
So go ahead and yuk it up but keep this in mind:

I do that, too. I wonder if now the rolling tobacco tax, which went up by 2200% when Obama took office, will be extended to pipe tobacco. The document seems vague on that detail, but I imagine it will. Why would they bring it up if not for getting their loot.
