The Troubling Prosecution of Waco Bikers

In Waco, Texas, authorities are still using a gag order to suppress evidence of what happened during the May 15, 2015, melee where 9 bikers were killed, some by the same caliber bullets used by police officers who fired their weapons that day. And newly available video underscores the likelihood that injustices are being perpetrated.

The carnage began after a fight broke out at a regional gathering of motorcycle clubs, including the Cossacks and the Bandidos, who started brawling in the parking lot.

There is no doubt that some bikers bear much blame.

The violence escalated quickly, but the parties responsible for the killings have yet to be revealed. In fact, the public has never been told how many were killed by police versus bikers, or whether that is known. Nevertheless, in the wake of the killings, 177 bikers were arrested. Authorities faced criticism for jailing so many, using fill-in-the-blank paperwork that didn’t differentiate among the jailed, even though it was always wildly implausible that so many bikers were involved in the killings. If the cops shot accurately, some of the guilty are presumably among the dead.

The vast majority of bikers present that day appear to have been shocked by the gunfire and inclined to flee the scene of lethal violence rather than to participate in it.

Yet prosecutors arrested the vast majority of this same group, later charging most of them. The videos make it seem plausible that dozens of people who fled trouble as expeditiously as possible have now spent almost a year of their lives in serious legal jeopardy, at great cost to their livelihoods and relationships.

I don’t know many bikers that I could imagine saying “I am Inclined to flee the scene of lethal violence”.................”LET’S HAUL A$$” maybe.

If ANYONE goes to prison, it should be that doosh Abel.

True justice would see him swinging from a rope for what he did to those people.

He destroyed many innocent lives.

The fleeing shouldn’t surprise anyone. Most bikers are dentists and lawyers these daze.

Owning a Harley isn’t cheap I can attest to that. I’ve been in a few places where club members, dare I say gang members were when I got there or arrived while I was there. Never had an issue but I usually don’t hang around (no pun intended) too long where they are. Living 2 hours from Daytona, I see outlaws occasionally, just leave ‘em alone and it’s no big deal.

Any of these bikers who strike a plea deal will be, in effect, eliminating their opportunities for winning damages from a civil suit.

A Tennessee court of appeals issued a turgid, 57-page decision last week that ruled that the Volunteer State’s gang enhancement law violates the due process clause of the Fourteenth Amendment. Yes, the Fifth Amendment also contains a due process clause. The Tennessee ruling has received considerable attention. Theoretically, it may effect the application of gang enhancements to criminal charges in other states. The Tennessee ruling is not as likely to accomplish that in and of itself as much as the 55-year-old ruling by the United States Supreme Court it cites, That old ruling seems applicable to many “gang” cases, particularly the slow motion “gang” case now underway in Waco, Texas.

Perhaps finding her and sending her to jail will help him win re-election.

Some complain about this investigation but it is serving to clean house.

It’s just unfortunate for all of us here on FR you aren’t part of that house cleaning project. You really should be. I have yet to see you do anything but cause hate and discontent plus copy and paste the same old nauseous nonsense every chance you get. Thank God you are the exception to the membership rather than the rule. All of which just proves you’re about as interesting as watching paint dry or waiting for an old computer to boot up.
