So, why not just change the rule to avoid this problem?

According to the GOP rule book, the rule cannot be changed until the Republican National Committee holds its convention meeting in 2016. Unlike 2012 when Governor Romney had sufficient delegate strength to stack the rules committee, absent a candidate emerging with the capability to achieve majority wins in states throughout the nation, the 2016 rules committee gathering will bear representatives from the many candidates still in the game—meaning anything can happen.

Rule 40 b requiring 8 state majorities for a nomination on the floor will preclude any candidate other than Trump and possibly Cruz to be nominated. This applies on the first ballot and any successive ballots. Just amend the rule? Guess who has the final say on any rule change at this late date? Trump and Cruz delegates ( well over the majority), on the floor of the convention and they will never change rule 40 b. Not only that but alerts were sounded back in January by party leaders that the bound delegate is prohibited from voting if his or her candidate is not in nomination thus reducing the "Majority" need for nomination to 50%+1 of voting delegates-- not 1237.

You’re under the mistaken assumption that delegates will be loyal. They won’t. They’ll go to the highest bidder.

You are absolutely right. Cruz and Trump will command the rules committee by their delegates. And I would say Cruz would have an advantage, as Trump didn’t do the due diligence required to get his delegates in many of these states.

Further, read this panicked plea by Virginia Republican National Committeeman, Morton Blackwell written last January to the RNC. http://www.redstate.com/diary/Morton_C_Blackwell/2016/01/11/urgent-amendments-national-rules-republican-party/

of particular import is this quote from his letter:

“With the same justification deliberately used in the presidential nomination roll call in 2012, that major candidate, the Convention Chairman, and the Convention Secretary could all agree that, because of Rule 40, no votes could be counted for anyone who did not meet Rule 40(b)’s requirements for having his or her name formally placed in nomination.

They would maintain that Rule 16(a)(2) itself contains wording by which any of the other existing rules – including Rule 40(b) and Rule 40(d) – trump Rule 16(a)(2).

Put another way, the powers that be could maintain that no delegate votes could be counted unless they were cast for a candidate who had been formally nominated under Rule 40(b). That intention was not avowed by those who wrote and hastily passed Rule 40(b), but events showed that they understood its effect and intended that no delegate votes would be counted in Tampa for anyone other than Mitt Romney.”

It appears to me that the RNC is now hoisted on its own petard.

Well, I see the rules change as not happening. This is a major possibility being avoided at Faux news.
At the risk of redundancy, speculate for a moment that no change of Rule 40 or 16 is approved by the delegates on the floor. ( Ryan will try a voice vote here but watch what happens) Note that the rules committee has 2 from each state. That is new from 2012. But even if they propose a rule change, it has to go to the floor. Let’s say that Cruz only has 4 states majority . Trump team will allow the number required to go from 8 top 4 in order to have the votes to block out everyone else ,Like all the Rinos that the RNC want to airdrop in with zero state majorities. This gives them total super majority on the floor. The floor must approve any change. Now , follow me here. The two are placed in nomination. Let’s assume 200 delegates are legally bound to vote for someone not in nomination. They are precluded by rule 16 from voting!! This drops the nomination “majority” to 1137 votes not 1237!! May the better man win. And I dont see that modified on subsequent ballots as to eligible candidates . You can only vote for a person in nomination. If delegates are released from ineligible candidates on the second ballot, that is where the money will fly. But there won’t be anyone in nomination but Trump or Cruz. Rules are Rules!!

Even conservative delegates for Cruz know in the halls of their conscience that this a corruption of democracy, of one man, one vote.

I keep saying you and I get one vote, in a primary contest.

Delegates get 2, 3, 4 votes, or more, beginning at National Convention, to flip the vote of the people, or defend it.

This arbitrary number of 1237 is rigged by all the automatic delegates represented in elected state office holders from all the states. Think how large that number is. In New York, it even includes EX-Mayors!

These automatic delegates are indebted to the “system”, and the system is GOPEstablishment.

Rules are set prior to the Convention by the Rules Committee, but voted on by the body of delegates in the Convention.

However, lest we forget, the RUUUULES can be changed *during* the convention as. it. progresses.

That dang 1237 is out of reach in a field of 17, compared to a field of six.

Endless money keeps many contenders in way too long and when they finally exit, the system ties up their delegates under the mantel of “unpledged” until Convention day.

These failed candidates then hold too much sway at the Convention, over their “unpledged delegates”, swinging them to whomever serves his or her interests and not to the will of the people.

Very well stated. I am sure the two teams Trump/Cruz are well ahead of us here. This is truly exposing the system and the party as corrupt and eroding any confidence that we had in democracy. In Studying this I was flabbergasted at the screw job on the Ron Paul faction of the party. All they wanted was a nomination of their man and recognition of their efforts on behalf of their man. THEY WOULDN’T EVEN ALLOW HIS NOMINATION!!. Now the law of unintended consequences brings its revenge. So be it.
I think Trump must honor Cruz on this to control the floor. Its possible that he wont . Right now Trump is the only eligible nomination at the convention. But I see the “Art of the Deal” in play.
In the Morton Blackwell letter to the RNC previously cited not these requirements for amending the rules .
“Amending The Rules of the Republican Party goes through four successive steps: The RNC Standing Committee on Rules; the RNC itself; the Convention Rules Committee; and adoption by the Republican National Convention itself. Amendments may be made at any step of the process.”

That is vitally important in confirming the requirement of floor approval of any rule change.

This is going to be quite a ride.

No one wants to say that. Maybe this debate will serve a purpose.

Just maybe if the debate continues and discussions could ensue, it would force TRUMP and Cruz supporters to realize that together they could change the Establishment strangle hold, and could lead the way in taking our country back?

The hard part is that I see the problem with Cruz is his past record and actions on policy, and others have a problem with TRUMP, on his record and actions on moral grounds.

Governor Tom Ridge is indicating a tweek to GOPE strategy. He seems to be trying to salvage John Kasickkkk, by starting to talk about “electability”.

He is saying the nomination is not reflective of a win in the General Election.

He is trying to prop up Kasickkkk, due to some poll showing Kasich besting Hillary, and being a “unifier” for those nasty old TRUMP and Cruz supporters.

They must be planning to exhaust the delegates at National until their hotel rooms EXPIRE, and they agree to settle a fueled combat scenario on the floor of the convention until delegates are ready to collapse and agree finally to compromise and nominate KASIKKKK.

People have planes to catch, etc. Don’t think the GOPE won’t set up just such dirty tricks.

You are correct. We desparately need a fusion Trump/Cruz team to take back the country and start us back toward a Constitutional Republic.

Trump/Cruz can do it, together. Separately, they may allow an unliked, corrupt Hillary to take control.

Hard to believe it has come down to the question of who is willing to put country before ego!
