SCO Again Returns From Dead, Plans Appeal

FOSS Force has learned that we shouldn’t write obituaries until we actually see a death certificate. SCO intends to file an appeal over the dismissal of its case against IBM.

On Feburary 29, we told you that SCO was “undeniably and reliably dead” after the company signed off on Judge David Nuffer’s dismissal of what remained of its case against IBM. Guess what? We were wrong. The once upon a time Linux and Unix company, which developed and distributed the Caldera GNU/Linux distribution, evidently has not yet been pulled from life support. On Tuesday, the company filed notification that it intends to appeal Judge Nuffer’s ruling to the United States Court of Appeals for the Tenth Circuit.

The bases of SCO’s appeal is not yet known. The papers filed only give notice that the plaintiff, that would be SCO, intends to appeal the decision. What is known is that the bankrupt company with no assets, other than its claim against IBM, is somehow managing to keep lawyers paid, which indicates that somebody’s lurking in the shadows hoping to eventually win the SCO lottery.

We can also assume that SCO’s lawyers aren’t working cheaply. According to the court document filed Tuesday, the company continues to be represented by the law firm Boies, Schiller & Flexner. David Boies is the same lawyer who prevailed over Redmond in the Netscape/Microsoft monopoly case and was almost responsible for having Microsoft split into two companies.

To hazard a guess, IBM’s response will likely be to revive its countersuits against SCO, and might even add a couple of new ones into the mix. It wouldn’t be a surprise if IBM pursued these counter claims aggressively, in an effort to help whomever is behind keeping SCO alive incur considerable legal expenses.

In the meantime, grab the popcorn and the M&Ms. This is turning out to be the longest death scene ever.

Should a potential malpractice claim against its lawyers also be counted an asset of the company.

I am of the opinion that SCO should try to develop a Linux distribution based on the micro kernel architecture of Minux3. They should focus on the real time market and dedicated devices with high reliability (Minix can reload drivers without a reboot of the system).

That product would not be a Linux distribution. It would be a Minux3 distribution.

Given the recent news about Ubuntu appearing with Windows 10, I think it’s unlikely that Microsoft is behind this recent resuscitation of the SCO zombie. Though I suppose Steve Ballmer might be privately finagling behind the scenes...

I was thinking just the opposite. Given the recent Windows10/Ubuntu news, that might mean the SCO can extract not only big money from IBM but royalties from Microsoft as well.

I could be wrong and often am, but this makes me go hmmmm.....

I had a greasemonkey script back in the heyday of GoldenEagle that would block all his posts on FR for me. Have considered digging it up again for all the Cruzbots/Trumpeters posters, just so I can get back to reading FR again. ;^)

Back in 1995, I worked for a company installing SCO Unix and Xenix on computers, installing multiport boards, and lots of Wyse dumb terminals.

Typically, my boss, co-owner of the company, would have me install the same “license” on multiple clients, saving him lots of money, but also having me break a few laws. I was a newb at the whole thing, and did it. I only worked there a short time (a year? 18 months tops).

No one even remembers Xenix.

God I’m old.

Is SCO still an operating company? I had the impression that it was only a litigation management outfit at this point, with any recoveries largely for the attorneys.

Not even remotely. It's a couple of lawyers hoping to scrape the last few nickels still stuck to the bottom of a dried-out cesspool.
