WACO -- McLennan County District Attorney Abel Reyna acknowledged Friday that a clerical error resulted in a 10th dead biker's name to be included among some of the indictments returned against 106 bikers in the Twin Peaks shooting. Only nine bikers were killed in the shootout on May 17th.
The nine bikers killed are all listed on the indictments. That list is made up of Delgado Rodriguez, 65, Richard Matthew Jordan, III, 31, Jacob Lee Rhyne, 39, Richard Vincent Kirshner, Jr., 47, Wayne Lee Campbell, 43, Daniel Raymond Boyett, 44, Manuel Issac Rodriguez, 40, Matthew Mark Smith, 27, and Charles Wayne Russell, 46.
However, some of the indictments include the name William Anderson.
Reyna released a statement on the error Friday:
"The inclusion of the '10th dead biker' in some of the Twin Peaks indictments was a clerical error on our part that can and will be corrected at a later date closer to trial. The additional name has absolutely no effect on the charges or the viability of those indictments. I regret this minor error has shifted focus away from the violent and dangerous crimes that occurred in the heart of our community on May 17, 2015."
Defense attorney Clint Broden released a statement on behalf of two of his clients, Burton George Bergman and Richard Luther, in response to Reyna's statement:
"McLennan County District Attorney Abelino Reyna released a statement today acknowledging that, in connection with the Twin Peaks case, his office was able to convince a grand jury to indict Mr. Bergman and Mr. Luther and other motorcyclists for the death of William Anderson, despite the fact that Mr. Anderson was not killed as a result of the Twin Peaks incident. Nevertheless, Mr. Reyna's statement seeks to minimize this fact by referring to it as a "clerical error" that "has absolutely no effect on the charges or the viability of those indictments."
"The fact that DA Reyna does not understand the magnitude of this error is shocking and disappointing. A grand jury was designed to act as a check on the prosecution. Nevertheless, Mr. Reyna was able to bamboozle the grand jury into indicting Mr. Bergman and Mr. Luther and other motorcyclists for a murder that Reyna now acknowledges they had absolutely nothing to do with. This is a sad commentary on the justice available in McLennan County and, unfortunately, gives new meaning to the old adage that a prosecutor can get a grand jury to "indict a ham sandwich" if he chooses. The fact that Mr. Reyan (sic) was able to obtain indictments for a crime which even he acknowledges did not occur is reflective of the way this case has been handled from the beginning."
A McLennan County Grand Jury indicted 106 bikers in mid-November on charges of Engaging in Organized Criminal Activity with an underlying charge of murder.
80 cases have yet to be presented to the grand jury. A judge ruled this week that the same grand jury will continue to serve for another 90 days.
A biker by the name of James "Spaz" Anderson died in a motorcycle accident in Nebraska when he hit a deer. Authorities believe he was at the Twin Peaks when the gun fight began and that he was struck by a bullet.
Fragments from that bullet were sent away for forensic testing to determine for sure whether it came from the shootout. The results have not been released.
Well it certainly seems to scream “You didn’t vet this very well.”

So in the representation to the Grand Jury it was stated that 10 people were killed? Do I have that right?

What do you call it when you have to have your undercover trigger man killed by a deer(yeah... more like John Deere) because he threatened to spill the beans because he was shot by the very people he was working for ?

This whole thing has smelled bad from the onset.
Maybe the secretary that he is trying to transfer the blame to was listening to ‘City Lights’ when she typed up the master indictment.
The grand jury presented on their oaths that 10 people were killed "then and there," with "there" being specified as McClennan County and "then" being specified as May 17, 2015.
We don't know what level of detail that Reyna represented to the grand jury, and it doesn't matter. The indictments are the formal legal instrument. They'll be challenged. The recitation of a tenth person killed ends up being irrelevant in court of law.

Long story short, most errors in an indictment are curable.
Errors happen.
