It is long past time when we amend whatever needs amending to provide for retention votes for the SCOTUS! They are without question the most corrosive of the three branches of government.

Actually, it was the Civil War which overturned Dred Scott.

“Stare Decisis” is the camel’s nose under the tent. Bad decisions are used as precedents for more bad decisions. It happened early in US history Marbury v. Madison. The Supreme Court is far more powerful than was intended.

If a decision is based on a law passed by congress, if congress changes that law, the supreme court decision is annulled, i think.

Plessy v Ferguson was overturned by Brown v Board of Education. No doubt there are other examples. In short, yes, a SCOTUS decision can be overtunrned by a succeeding court.

No, if the decision is an interpretation of a federal or state statute or regulation not invoking constitutional grounds, the cognizant legislature or agency can overturn the decision through its legislative or regulatory authority.

Since Obama has NSA files on both the members of Congress and the Supreme Court justices you may have to wait awhile unless someone with a conscience comes forward and I don’t see that happening to the blackmailed...

Correct. We need a constitutional amendment to allow a certain number of states to nullify past or present Supreme Court decisions. They were never intended to rule on the constitutionality of a law. To do so would make them dictators. Although they userped the power, the Supreme Court exercised restraint in its use for quite some time. But all hell broke loose when FDR threatened the court. And we have been dictated to ever since by the black robed tyrants. In addition to the amendment I listed we need another amendment to prohibit the Supreme Court from ruling on the constitutionally of any law.

But that was the Supreme Court overturning what a previous Supreme Court had ruled. I don’t mean going before the Supreme Court and begging “pretty please”, I mean taking it totally out of their hands.

Only the supreme court can overturn their prior decision.

Dred Scott was overturned. It took 600,000 American lives to do it.
