The man accused of bashing a gay couple with a chair in a Chelsea barbecue restaurant surrendered to cops Tuesday — but hasn’t been arrested on hate-crime charges because he’s gay, too, police sources said.
Bayna-Lehkiem El-Amin, 41, surrendered to NYPD Hate Crime detectives at the Seventh Precinct with his attorney and was charged with assault and attempted assault. His arraignment was pending Tuesday night.
A police source said El-Amin wasn’t charged with a hate crime because the Bronx man was gay and the attack wasn’t motivated by hatred of homosexuals.
El-Amin allegedly slammed a chair over the heads of Jonathan Snipes, 32, and Ethan York-Adams, 25, during a brawl inside a Dallas BBQ on Eighth Ave. near W. 23rd St. on May 5.
According to a jaw-dropping video taken during the fight, the 6-foot-6 El-Amin began stomping one of his two victims before several patrons started pulling him back. York-Adams and Snipes appear to be egging El-Amin on, then turned their backs to him, the video shows. A split-second later, El-Amin picks up a chair and brings it down on their heads.
Writing on the blog The G-List, El-Amin said that he was attacked first.
"I was the victim ... I was sitting at my table," he wrote. "With no provocation, he came up and hit me. There was no slur thrown at him."El-Amin’s attorney, Brian Hutchinson, said his client’s sexual orientation wasn’t discussed with detectives.
“(The detectives) showed us the entire video from the restaurant, and it was determined that he was not the aggressor,” he said “(Snipes and York-Adams) made sexuality an issue.”
Snipes couldn’t be reached for comment Tuesday evening.
I’ve never met a normal homosexual. They are all nuts. some a little, some a lot.

so a homosexual can beat another and it’s a crime , but if I smacked a homosexual who is mouthing off to me then I am charged with a hate crime and face more time in prison.

Time to get rid of these hate crimes and time for these minorities to stop acting up and getting in peoples faces
Every homosexual I have met seem to have some kind of daddy issues for women and for men who seem to have either men issues or mental issues. Either way they’re in need of help not encouragement.
Isn’t El-Amin a muslim name? At a BBQ? And he’s gay besides?

Because we have entered the Orwellian nightmare of Thought Crimes.
If you hit someone else, that’s just assault.
But if in your mind you hate that person because of some PC-protected class, then that hatred is a crime unto itself.
By so classifying thoughts and feelings, they begin to force us to police our thoughts and feelings.
That is why they are called Thought Police.
Where are the retractions and apologies to the heterosexual community?
Maybe there needs to be a HAIR group to lobby on behalf of hetrosexuals.

Indeed. And we need to stop worrying about causing social discomfort by speaking up.
We need to get in their faces to push the tide back — use the the same tactic this <2% of the population has forced their deviancy down our throats. Being bold. Acting hurt when they persecute us for our religious beliefs.
I do and have told a homosexual woman recently she was not married after she kept getting in peoples faces about it.
Sadly there are far too many who don’t speak up or even tell their friends , family, and neighbors what they really think for fear or being called a silly, little name.
Never been there so I guess I’ll never understand it.
My little town in flyover country suits me quite nicely.
And a BBQ that’s better known for being watering hole than for its subpar BBQ.

Apparently. There is almost no place in NYC I would less expect to find an observant Muslim than in a bar - in Chelsea - that serves hundreds of orders of pulled pork sliders every night.

I’ve lived in NY, and have lived in flyover country.
NY has its advantages, even for conservatives.
But most NYers have no idea how pleasant it is to live in much of the Midwestern US.
