I just got a couple of job inquiries, where having an H1-B visa is a must. Is there a way to report these jokers to the appropriate agency?
I see that a lot in IT employment ads. What they mean is that if you are not a citizen it is a must.
Are you saying that they are only hiring resident aliens at the expense of American citizens?
They’re also setting salary expectations.
“I just got a couple of job inquiries, where having an H1-B visa is a must. Is there a way to report these jokers to the appropriate agency?”
That is terrible.
The question is, is there a way to report this to somebody who gives a crap.
And this nonsense of Korean busniesses in Korean communities hiring only Koreans, or Muslim-run companies hiring only Muslims, Chinese hiring Chinese, etc., should be exposed and stopped. How comes white males are the only people NOT allowed to be racist?
Theyre also setting salary expectations.
I’ve ignored that. I got a contract in Seattle that had that warning and it paid $55 an hour. This was over a decade ago, though.
Maybe Obama is giving tax breaks to companies who hire the foreigners he’s allowed in.. This helps build the Democrat voter base.
Is it illegal to offer a job to non-citizen visa holders to the exclusion of citizens? Apparently so.
Note the interesting wording of this EEOC website:
http://www.eeoc.gov/laws/practices/inquiries_citizenship.cfm
“Employers should not ask whether or not a job applicant is a United States citizen before making an offer of employment. The Immigration Reform and Control Act of 12986 (IRCA) makes it illegal for employers to discriminate with respect to hiring, firing, or recruitment or referral for a fee, based on an individual’s citizenship or immigration status. For example, the law prohibits employers from hiring only U.S. citizens or lawful permanent residents unless required to do so by law, regulation or government contract; it also prohibits employers from preferring to hire temporary visa holders or undocumented workers over qualified U.S. citizens or other protected individuals, such as refugees or individuals granted asylum.”
send your info to drudge, breitbart, beck etc so it gets some attention etc.
or the IEEE:
They will not be the agency you report these clear employment violations to, but they should have information on who to send these complaints to.
My best guess would be the EEOC. Place of national origin is not supposed to be used as a criteria for hiring. And definitely shouldn't be if your place of national origin is the USA!
Get local TV coverage.
Find a "Better Call Saul" lawyer to cause a ruckus.
It means they will only hire aliens and then they’ll claim that Americans “won’t do” the job.
Both parties want it this way. They have decided that jobs will go to India. Another instance of redistribution of income.
“The question is, is there a way to report this to somebody who gives a crap.”
True, and PROVING a case is next to impossible. These people have been doing it for years, and they are very, very good at it.
Unless you are the business owner, be very careful.
I was threatened by HR for even suggesting this.
Not in IT.
You have to show injury.
Make the application and wait for them to deny it.
Then find an organization like Judicial Watch to represent you.
Often just the threat of legal action will stop the policy.
Federal laws require that H1Bs not be used until it is demonstrated that Americans are not available.
