In order to win a defamation action, the plaintiff must establish that he was indeed defamed and that the objectionable symbol (in this case) was the proximate cause of the injury.
So tell me how Chief Wahoo defames anyone? Where is the injury? Being offended is not the same as having one’s standing or reputation diminished. If anything, Chief Wahoo elevates the reputation of Indians by equating them to noble fighters and staunch champions.
Cleveland should charge the Indians for the advertising.

Another component of a successful defamation settlement is that the judgment will make a material contribution to remediating the injury. How is giving a bunch of drunken rez-dwellers truckloads of money going to erase this imaginary “damage?”
This case should be summarily dismissed.

One of the few times I would side with Native Americans on this stuff. Chief Wahoo is a damned insulting caricature IMO.
By comparison the Washington Redskin, North Dakota Fighting Sioux, etc. are respectful, realistic presentations.

I'm offended by idiots suing for no reason at all except that they are going after someone with deep pockets.
I would like to see the Cleveland Indians counter-sue this profiteering group and have the thieves represent all the lazy, greedy, money grubbing suers that hope to win the lottery from someone or some organization that has worked for 100 years to get the money that they resent.
