LOS ANGELES (CBSLA.com) A lawsuit filed by a former server at a trendy Melrose Avenue restaurant alleges a new owner sought to replace female servers with handsome men.
The lawsuit filed in Los Angeles Superior Court against The Larchmont includes allegations of wrongful termination, discrimination based on gender, retaliation and intentional infliction of emotional distress.
According to the suit, Lauren Costa was hired as a server in 2008 at the eatery located at 5750 Melrose Ave. when it was known as the Larchmont Grill, which was sold in January to a group that changed the name to The Larchmont.
One of the new owners, Robert Kass, who is named in the lawsuit, is a homosexual and openly discussed his sexual orientation with his staff, according to the suit.
In the lawsuit, Costa alleges Kass would only greet and chat male staffers upon arriving at work and was condescending and rude when he did greet Costa.
She was removed altogether from the restaurants employee schedule and terminated on June 21, according to the suit.
Costa also alleges she is owed back wages for overtime pay and that she was not provided sufficient meal and rest periods.
A representative for The Larchmont did not immediately respond to an email seeking comment on the suit.
I read the title and asked myself “Why?” yet knew the answer before I even read the article.

Ms Costa needs to change the language in her lawsuit leaving off mention of homosexuality and emphasizing plain old male sexism if she wants it to succeed.
Not that I was ever going to eat there anyway— but now I’d be afraid of catching hepatitis (or worse)
Preliminary attempts to find Ms. Costa’s pic have failed.
The FR jury will remain empaneled pending evidence.

I’d never eat there, either. I do, however, defend his right to hire or fire anyone for any reason whatsoever. Such is (or should be) the case with all at-will employees.
I guessed it too. Waiting to see who trumps who in this clash of liberal ideals - homos vs. feminists.
Ihate to say it, but a former high-rolling Chicago exchage type once told me that in the high-end restaurants it was de rigeur to hire fastidious homosexual waiters, and Hispanic bus boys. In theory, such hires would make the hire based on the impression it would leave on the guests.
No, you don't pump your own gas there. And, no, they don't have idiotic laws about who you can hire.
It was fun to see these cute chicks, surround your car, wash your windows, check your oil and pump your gas. My daughters thought it was fun, too. My wife, not so much.
Unfortunately (or maybe fortunately) my current financial situation precludes me from going out for fast food — let alone high end dining.
Hamburger Hamlet used to hire only black waiters. We ate there anyway.
