The militia encompasses every able-bodied male between the ages of 18 and 45.

So if you're over 45 you no longer have 2nd A Rights? Am I missing something?

The Founders addressed this issue after the Bill of Rights. They said “Who is the Militia?” and answered it with, “The whole of the citizenry between (two ages I can’t remember but I think it was up to about 60). I thought the same thing, but I think they were just saying the militia wouldn’t have anybody above 60 in it. No one said you lost your right of self protection after 60, but you wouldn’t be expected to show up for war.

Although I have read commentaries about the Dick Act I have not yet read the actual legislation. And there are problems with the commentaries, the claim that it cannot be repealed for example. Legislators can arguably repeal their own legislation in the next day if they want to.

Thanks!

I know a law/Act can’t supersede the Constitution, but I wasn’t quite clear of the wording and why it would be perceived as a good Act.

Also look up title 26 USC 5845 firearm definition:

Firearm. (a) A shotgun having a barrel or barrels of less than 18 inches in length; (b) a weapon made from a shotgun if such weapon as modified has an overall length of less than 26 inches or a barrel or barrels of less than 18 inches in length; (c) a rifle having a barrel or barrels of less than 16 inches in length; (d) a weapon made from a rifle if such weapon as modified has an overall length of less than 26 inches or a barrel or barrels of less than 16 inches in length; (e) any other weapon, as defined in this subpart; (f) a machine gun; (g) a muffler or a silencer for any firearm whether or not such firearm is included within this definition; and (h) a destructive device. The term shall not include an antique firearm or any device (other than a machine gun or destructive device) which, although designed as a weapon, the Director finds by reason of the date of its manufacture, value, design, and other characteristics is primarily a collector's item and is not likely to be used as a weapon. For purposes of this definition, the length of the barrel having an integral chamber(s) on a shotgun or rifle shall be determined by measuring the distance between the muzzle and the face of the bolt, breech, or breech block when closed and when the shotgun or rifle is cocked. The overall length of a weapon made from a shotgun or rifle is the distance between the extreme ends of the weapon measured along a line parallel to the center line of the bore.

The above definitions are the only recognized identifications for a "FIREARM..... which means all those in jail, prison for alleged "Firearm" violations are there by the system filling these revenue generating corporate jails.

Dick act 1902 "efficiency of Militia act" invalidates all gun laws to repeal would be a "bill of attainer"

The gun rights crew have been looking for a silver bullet for decades now to squash the controllers, but haven't been able to beat them down to a whimpering mass of jelly. The fact will always be that the 2nd Amendment is a big problem for the controllers. These emails that shout "Eureka! we now have the Holy Grail for gun ownership" always end up as something wrongly interpreted. We seem to have settled on some ability to regulate gun ownership over the years, but our Founders were addressing a whole other principle.

The Founders knew the individual ownership of arms guaranteed a tyrannical government would never be allowed to rule over free citizens. Today, we can see the tyranny barking at the door and they will never be able to complete their "Utopian" vision. Gun control is mandatory to go much further.

I'm not exactly a one issue voter, but views on the 2nd Amendment are right there next to abortion on my voting list. Without the 2nd Amendment, the other 9 don't exist. Life is mandatory in order to enjoy the other benefits of Freedom. Tax rates and war stances all fall second to the ability to live free. Weapons insure that we will not live under slavery. Too many give up their vote for freedom to get another $5 on their Social Security. Guns aren't that big of an issue in their homes.

The beauty of our Founders were they knew the weakness of men and wrote laws to insure the people wouldn't fall prey to tyrants. What they didn't anticipate, IMO, is the weakness of the populace to take God given rights for granted and give them up for temporary things. In the end, voting will keep us free, not some long forgotten act found in a dusty book. IMO, we are at the cliff of losing everything today. Knowing they are building databases on everyone on everything puts gun ownership in the absolute forefront for thinking people. Today, we know they are saving DNA, fingerprints, licence plates, phone calls, internet posts, and even video of EVERYONE to keep forever, should give pause to any thinking patriot. Obama just signed an Executive Order to make HIV testing mandatory for everyone to force everyone testing positive to take treatment. What are they going to do with the blood of people that test negative? They are already saving blood from each and every baby born in the last 10 years or so. What are they doing with fingerprints on our drivers licenses? You just thought it was bad to have your phone calls logged. Before Obama leaves office, it may be possible for the government to know everything about everybody. Our only hope will be about individual ownership of guns. We can always right the wrongs and change it back if we can defend ourselves. Voting however, takes less bloodshed.
