5-Year-Old Handcuffed, Charged With Battery On Officer

STOCKTON, Calif. (KCRA) -- Earlier this year, a Stockton student was handcuffed with zip ties on his hands and feet, forced to go to the hospital for a psychiatric evaluation and was charged with battery on a police officer. That student was 5 years old.

Michael Davis is diagnosed with Attention Deficit Hyperactivity Disorder or ADHD. His mother says it has led to fights at school. But when the school district said it had a plan to change Michael's behavior, his mother says things went wrong.

"Michael is energetic," Thelma Gray said. "He is one big ball of energy."

Gray calls Michael a comedian. She says his biggest problem is his ADHD stops him from thinking before he acts or speaks.

"He's very loving," Gray said. "He's a good kid and he's not the discipline problem that he was made out to be."

Those discipline problems include fights with other students, even throwing a chair.

Gray says the school, Rio Calaveras Elementary of Stockton, wanted to change that behavior by having Michael meet with a school police officer.

Here's a shocker for you!
I don't care if or why mom is or isn't at home, or whether or not Dad is around. I don't consider that any of my business.

I do care that my taxes go towards paying for a bloated, corrupt, and inefficient public education system that is consistently failing to fulfill their supposed government charter in our society.
Compulsory K-12 education has drifted far beyond the noble goal of providing a “free” opportunity for every minor child citizen of the USA, to obtain at least a basic level of literacy involving reading,writing, mathematics, science and history.

The K-12 compulsory education system has devolved into a bureaucracy more concerned with expanding their power, money and benefits than educating children.

oh, and cop needs to find another line of work.

As do the over educated people that think all children who can't perform like regimented adults should be drugged into submission.

Personally, I'd pay good money to see all the elementary school teachers and administrators be forced to sit still for 6 hours everyday, be forced to eat lunch without speaking, have no recess time and be hollered at for squirming after several hours this regimentation. Ditto for the doctors that rubber stamp the opinions of a teacher that says a child who doesn't have the attention span of an adult should be drugged.

I've seen it up close. I wouldn't be surprised if they wanted to pump soma into the a/c vents every day a la Huxley.

Parents of children with genuine problems, don't bother flaming me. What I've said about the system is still true.

Thank you for bringing this up. My Nephew has severe autism...THE ORIGINAL autism..not this umbrella autism they stick little boys under when they have ants in their pants. And you are correct. So much of it is food allergy. If people really knew they’d be shocked. I was just speaking to a gal whose son had all the characteristics of autism...the wanted to put him on drugs, but she did her own research and changed his diet..CELIAC disease...he’s fine now.

One middle school has banned any sports with “balls” cause a parent on the sidelines got hit in the head with a flying ball...I give up.

“She knows because she ultimately obtained a copy of the police report.

In it, the officer, Lt. Frank Gordo, says he placed his hand on Michael’s and, “the boy pushed my hand away in a batting motion, pushed papers off the table, and kicked me in the right knee.”

When Michael wouldn’t calm down, Gordo cuffed Michael’s hands and feet with zip ties and took the boy to the Stockton Kaiser Psychiatric Hospital in the back of a squad car.

He had not called Michael’s mother or father at that point.”

Think about this. The boy went beserk when the cop touched his knee. We are not allowed to touch cops but a cop can touch this kid? Furthermore, the kid goes wild when touched? The cop did not suspect some kind of sexual abuse in the child? Oh good job officer. Yes and officer always a good idea to be alone in the room with a child this young just asking to have sex abuse charges brought against you years later.

This thing was a cluster f**k from the get go.

I don’t think I’d automatically suspect child abuse because the kid went berserk when being touched by the cop. My kid would have gone off had a stranger done the same thing. Probably would have started screaming to high heaven. We can’t really get a feel for the emotional dynamics at that moment.

Personally, I don’t think the average 5 yo boy should be in public school all day to begin with. Not that I am assuming this kid is average. And we shouldn’t be calling out police to deal with 5 yo behavior problems. Loony.

You can bet the bank that everyone involved in this incident is massaging their version of events.

If the cop was alone in the room with the boy, that's unfortunate. That is not a reason to do nothing.

A 5 year old cannot be left alone, especially if they are disturbed. Neither can they be allowed to go berserk, damage property, or injure themselves or others.

The only recourse for ANY non-parental adult is to restrain the child. Based on the little I know from this story, I think the cop did the right thing.

I am completely on the side of the public when a child goes berserk. They must be stopped & restrained immediately, & the parents held entirely responsible for the behavior of the child, to the point of criminal charges of neglect & abuse, plus payment of damages.

Until there are serious penalties for failure to raise a human child vs. a wild animal, society will continue to decline.

I have checked him for that already since I constantly battle it. I think it’s just the extra sugar in his diet. He was never a sugar lover anyway. He doesn’t eat candy and will only take a few bites of cookie. I ordered the Vitamix last night. Hopefully adding the fiber to his juice will make a difference. Fingers crossed!
