This was the warning cited by Craigslist as I prepared to post an advertisemnet to rent my house. They specifically warned against using the term "Christian Household" and mentioned fines and penalties up to $10,000.

They then referred me to the "Federal Fair Housing Act."

When a word like "Fair" is so widely used and even written into Federal Laws, it means we are well on our way down the slippery slope.

I immediately recoil whenever I her a slick "Public Servant" use the word "fair." No one ever bothers to ask for a precise definition.

A lot of evil is being promoted under the guise of "fairness."

The FFHA was passed in 1968... Not exactly a recent phenomenon. It’s been illegal since that time to discriminate by religion in real estate sales/rentals.

Renting out property is a very intricate dance...

There are things you want and don’t want out of/with a tenant.
Most requests and wants are illegal in all 57 states....

Internalize your wishes - Use the Force....:>)

It sucks, but I think they’re right, as the “Federal Fair Housing Act” prohibits, among other things: “Refusal to sell or rent a dwelling to any person because of race, color, religion, handicap or national origin.”

Another shameful legacy of Lyndon Baines Johnson.

So, most people accomplish their goals while abiding by the letter of the law.

Simple solution: once you’ve used a service to weed out the definitely undesirable - by using a credit reporting agency that focuses on tenants - just have a nice conversation with each prospective tenant; about half an hour or so should be enough to sort out the rest according to your own preferences.

A good thing to do is simply state “credit check” in your ad and follow through with one on prospective tenants. This keeps out 99.99% of the rif-raf.

There are very good outfits on the internet that do them fast.

Another thing to keep in mind is that the Federal Fair Housing Act does not apply to renting apartments/rooms in owner-occupied buildings nor to rentals of single-family housing rented without a broker.

You still cannot advertise it using the liberals’ naughty no-nos.

There has also been debate about whether the phrases, “master bedroom” and “master bath” amount to race code. The word “master” implies that the rooms are for plantation owners, I guess.

I’m not joking.

I wonder what reaction you would get if you advertised for “Smokers Only”.

Renting agent advised a neighbor who wanted to lease her home that she had to eliminate her smoking history (would have cost a fortune) - she said “Advertise - ‘smokers only’ need apply”.

She fired him!!!

Also, you can require as much of a refundable deposit as you wish. Get three months up front. That will help weed out some of the scum as well. Also, a laughing, friendly conversation with prospective teanats wherein you mention your "partner" can help. "Sorry, but my business partner couldn't be here today. That psycho is probably explaining something to the cops again. Whatever. I'm sure you'll never have to meet him." This helps establish that it might not be a good idea for a tenant to stop paying rent and then abuse the courts to squat for a year or more, rent free.

Yes BUT there are also the pertinent state regulations which MAY EXCEED the Federal laws. Witness the Michigan case (Oct. 2010) where a 31yo woman put a notice upon a CHURCH bulletin board advertising for a CHRISTIAN ROOMMATE. She was sued under this Fair Housing Act by the Fair Housing Center of West Michigan in Grand Rapids, MI and the case was taken up by the Michigan Department of Civil Rights. if convicted, the woman could face several hundreds of dollars in fines and “fair housing training so it doesn’t happen again.”

After a firestorm of publicity and assistance from the Alliance Defense Fund (ADF), these various government agencies backed down from this SPECIFIC CASE but still maintained that they would do it again under similar circumstances. Last I heard, the Fair Housing Center of West Michigan still has the right under the law to sue this woman in Federal Court for this violation for 2 years after the posting of the bulletin board notice.

The point about more restrictive state laws is good; however, the discussion is primarily on the federal laws, which is why I specifically carved out advertising, which would include putting a sign up on a bulletin-board.

As someone else pointed out, though, there is no rule against listing political preferences, so why not advertise for politically-conservative tenants? Fact of the matter is, you are much, much less likely to get a liberal than a Christian with that sort of an ad.

Furthermore, why not simply describe yourself - using terms that are likely to cause the sort of self-selection you want?

Finally, as I said earlier, a nice little chat with any remaining prospectives should easily winnow the field - simply make sure that you describe who you are and how you live your life, and by implication what you expect from a tenant. Also, keep in mind that the illegality in this case extends to advertising, not to the actual rental, so once you're talking face-to-face with a prospective, you have a lot more freedom to ask questions and to refuse to rent on the basis of things like religion.

What that woman in your story did wrong was advertising her preferences, not acting on them.

Many states do not allow an unlimited amount for a deposit. In Hawaii you may only collect a “security deposit” equal to 1 months rent. That’s all - no first, last, and deposit.
