However, it's not the courts' place to fix this. And they probably won't touch it.
The problem is that up until this year, we've always taken a candidates word that he was eligible. That was always good enough.
Therefore, when Obama gives his word that he's eligible, the courts will see that as "good enough."
If someone out there has strong, irrefutable proof that he's lying, and that person with the proof comes forward with the right kind of complaint in the right court, it might be heard. But none of the cases being brought forward have strong, irrefutable proof that he's not a "natural born citizen."
No court is going to compel Obama or anyone else to produce documents (like valid birth certificates). It won't happen. There is no basis in existing law to force this issue.
And any court that takes the vague "natural born citizen" clause of the Constitution and somehow finds a requirement to provide a birth certificate in that clause could do far worse things with other parts of the Constitution.
For example, imagine Medicare going broke and not able to pay claims. A court could look at the existing Medicare laws, and the power of the federal government to tax to "provide for the ... general welfare of the United States" and decide (and order) that tax rates for Medicare must be increased immediately because Congress isn't doing their job providing for the general welfare of the United States.
I'm not comfortable at all with courts making up new laws as they go. That's the function of the Legislative branch.
And the proper place for this issue to be addressed is in the Legislative branch.
In this cycle, it could be handled by a challenge in the House and the Senate when the electoral votes are counted and certified. With the Democrat party controlling both houses of the congress, I doubt that will happen, but that's the appropriate place to take this issue.
In future election cycles, it can be handled by statute. State and possibly federal laws can be written to establish eligibility requirements beyond taking a candidate's word that he's eligible. And I believe that is more appropriately handled at the state level.
If you want a law requiring Presidential candidates to prove that they are eligible for the office, ask a Legislator to write it. Don't ask a Judge to write the law from the bench.
Section 3 of the 20th Amendment - “if the President elect shall have failed to qualify”.
That clause puts the burden on the President elect to prove he or she qualifies. True, if doesn’t specify a birth certificate, but how else is the person going to prove he or she qualifies?

Hate to break it to y’all, but this WAS in the papers. They interviewed a number of friends who saw her & talked to her during her brief visit, and later during her stay when she returned.
There really ISN’T anything here. The most unqualified man in history has been elected President. No one cared. A man steeped in the corruption of Chicago has been elected. No one cared. A weirdo who despises the only ones who ever cared for him (his grandparents) has been elected. Period.
Also, Obama has spent approximately $1,000,000 in legal fees to hide his original birth certificate. I believe that it will prove him to be ineligible to serve as President.

If a bunch of left wing moonbats had filed these kinds of lawsuits in 2000, and tried to force George W. Bush to show his birth certificate, and Bush didn't want to be the first to cave in to this kind of stuff and refused, I'd bet that over ninety-nine percent of the "birth certificate" challengers today would have told the moonbats to "get over it" and "George W. Bush won."

It’s clear there is a distinction between qualifying and claiming to qualify. But you’ll never agree, so there’s no point in continuing a discussion with you.
The same way every other President has proved their qualifications, he’ll say he’s qualified and win the election. That’s how it’s always been.

If, as you say the precedence is set by prior presidents, then it should be noted that all prior presidents were natural born citizens except Chester Arthur, who went to great lengths to hide it.

Madelyn Dunham could NOT be Jr’s mother. Ann was definitely his mother and she passed on the Dunham genes which show in Jr’s resemblance to Stanley Armour Dunham. Aside from the obvious negroid features Jr exhibits if you see photos of Jr and his grandfather you would see that Jr is more white than he cares to admit. He actually obsesses on his negroid blood to the exclusion of his white blood. An obsessive personality is dangerous to have as President and CIC.
If people had cared to read the words his grandmother said to him after his 2004 speech the warning flags would have been raised. His grandmother knew him better than other people and she told him, “You did good, don’t let it go to your head.”
