I saw Man of the Year the other night -- it was funny enough. Afterward my girlfriend and I got into a discussion -- what would happen if massive vote fraud/computer error were discovered in a Presidential election?
In the movie it was implied that a new election would be held. I thought of a few things....I had to look up the citations though.
(1) If the fraud/error were discovered before the first Monday after the second Wednesday in December (3 U.S.C. 7), state legislatures could choose a method of selecting electors, so long as that method was completed by the fourth Wednesday in December (3 U.S.C. 12).
(2) If the fraud/error were discovered after such date, it would take one Senator and one Representative to object to the vote. (3 U.S.C. 15) If both houses of Congress agreed to throw out the results of a particular state or states, and no candidate had a majority, then the choice of President would devolve to the House of Represenatatives (wherein each state gets one vote), and the choice of Vice President would devolve to the Senate, wherein each senator gets one vote.
She told me I was full of cr*p, and that 300 million people would demand a new election. I told her that it was more important that the Constitution be followed.....although in retrospect this is more statute than Constitution.
She told me that the Constitution is rarely followed. I told her that each law has some constitutional basis in case it is challenged. She ended up getting the last word but I'd like an expert opinion.
Also in the previews there's a movie coming out about the Dixie Chicks that mentions Free Republic.
You might have an opinion on this one -- or maybe not.
many think that Manhattan and Malibu should decide whom presides over our Constitutional Republic.

My opinion... don't argue with your girlfriend, no matter if she is wrong or not.
After you get married you won'y have any opinions anyway, might as well get used to it.
Not only does the Constitution not require a second, public vote, it forbids that. The public election must take place on the specified day, and at no other time.
