The Supreme Court of the United States has punted on the enforcement of equal treatment under the law, several times. (affirmative action) Bakke was the first example, as I recall.

They have said Universities can discriminate against people of certain color, or views, or origin, as long as they say they are doing it for "diversity".

From that green light by the Supreme Court, the rest of University speech codes and cancel culture flows, quite naturally.
